तक उनको सपोर्ट नहीं मिल पाया उतना अच्छे

तो उनके लिए अगर मान लो वो लोग कह दें
राज्य कि हम 10 पर रिजर्वेशन देना चाहते
हैं और बाकी के स्केड्यूल कास्ट के लिए 5
पर रिजर्वेशन रखना चाहते हैं तो ये जो
कैटेगरी इजेशन है इसको इनवैलिड करार दिया
था सुप्रीम कोर्ट ने 2004 में कि यहां पर
स्केड्यूल कास्ट को हमें एज अ हो होमोजीनस
ग्रुप के तौर पर देखना होगा एक सिंगल
ग्रुप के तौर पर देखना होगा आप उसके अंदर
अलग-अलग कैटेगरी नहीं डाल सकते मतलब जितने
भी लोग शेड्यूल कास्ट के अंदर आते हैं उन

देख सकते हो यहां पर सात जजों की बेंच
बैठी थी जिसके अंदर चीफ जस्टिस ऑफ इंडिया

जो रिजर्वेशन होगा व बाल वाल्मीकि और जो
मजहबी सिख कम्युनिटीज हैं उनको दिया जाएगा
क्योंकि आज भी अगर आप देखोगे जो वाल्मीकि
और मजहबी सिख कम्युनिटीज हैं पंजाब में वो
सबसे ज्यादा इकोनॉमिकली और एजुकेशनली
बैकवर्ड कम्युनिटीज हैं पंजाब के अंदर तो
इस पॉलिसी के तहत पंजाब सरकार ने यह कहा
कि चाहे वो एजुकेशन इंस्टिट्यूट हो या फिर
पब्लिक एंप्लॉयमेंट हो वहां पर पहला
प्रेफरेंस रिजर्वेशन का इन दो कम्युनिटीज
को मिलना चाहिए फिर जो दूसरा कैटेगरी लाया
गया इसके अंदर उसमें बाकी के जो शेड्यूल
कास्ट के कम्युनिटीज के लोग हैं उनको यहां
पर रखा गया तो यहां पर क्या है कि यह 1975
में जो पूरा मामला आया था पंजाब सरकार ने
नोटिफिकेशन जारी किया था तो अगले लगभग 30
साल तक तो ये चलता रहा 20034 तक लेकिन फिर
देखिए यहां पर क्या होता है 2004 में
प्रॉब्लम हो गई प्रॉब्लम क्या हो गई कि एक
आंध्र प्रदेश का मामला गया था सुप्रीम
कोर्ट ने क्योंकि आंध्र प्रदेश ने भी एक
इसी प्रकार का कैटेगरी इजेशन किया था और
आप देख सकते हो यहां पर आंध्र प्रदेश
शेड्यूल कास्ट नेशनलाइजेशन ऑफ रिजर्वेशन
एक्ट टू 2000 जिसके अंदर यहां पर आंध्र
प्रदेश ने क्या किया शेड्यूल कास्ट के
अंदर बहुत सारे कैटेगरी बना दिए मतलब हर
एक शेड्यूल कास्ट के लिए अलग-अलग
रिजर्वेशन दिया गया किसी को 1 पर किसी को
2 पर किसी को 5 पर इस तरह से यहां पर दिया
गया था तो ये मामला गया था सुप्रीम कोर्ट
में और उस समय पांच जजों की बेंच में तो
ध्यान रखिएगा उस समय जो 2004 का फैसला था
वो पांच जजों की बेंच का फैसला था और
उन्होंने आंध्र प्रदेश का ये जो
नोटिफिकेशन है ये जो एक्ट है उसको अन
कांस्टीट्यूशनल डिक्लेयर कर दिया और
सुप्रीम कोर्ट ने बेसिकली उस समय क्या
बोला सुप्रीम कोर्ट ने यह कहा कि इट
वायलेट्स द राइट टू इक्वलिटी जो हमारा
फंडामेंटल राइट है राइट टू इक्वलिटी का
उसको वायलेट करता है क्योंकि यहां पर जब
स्केड्यूल कास्ट की लिस्ट आती है वह
होमोजीनस ग्रुप है उसको हमें एज अ सिंगल
के तौर पर देखना पड़ेगा आप उसमें डिवाइड
नहीं कर सकते क्योंकि यहां पर यह भी बोला
गया कि कांस्टिट्यूशन के अंदर जो
स्केड्यूल कास्ट को रिजर्वेशन दिया गया है
इट हैज बीन गिवन बिकॉज हिस्टोरिकल उनके
साथ डिस्क्रिमिनेशन हुआ है तो हम
स्केड्यूल कास्ट के अंदर अलग-अलग डिवाइड
नहीं कर सकते और साथ ही साथ सुप्रीम कोर्ट
ने एक और यहां पर कारण दिया था कि देखिए
आर्टिकल 341 ऑफ कांस्टिट्यूशन उसमें लिखा
हुआ है कि प्रेसिडेंट के पास पावर है कि
स्केड्यूल कास्ट के अंदर कौन-कौन से लोग
होंगे तो वो प्रेसिडेंट वो लिस्ट बना सकते
हैं तो राज्यों के पास इसका हक नहीं है तो
आई होप आपको समझ में आ गया होगा कि
सुप्रीम कोर्ट ने 2004 में ये फैसला
सुनाया कि स्केड्यूल कास्ट हो या या फिर
स्केड्यूल ट्राइब हो वहां पर सब कैटेगरी
इजेशन नहीं किया जा सकता और फाइनली क्या
होता है कि सुप्रीम कोर्ट का यह फैसला आने
के लगभग 2 साल बाद पंजाब और हरियाणा हाई
कोर्ट ने भी जो 1975 का पंजाब सरकार का
नोटिफिकेशन था उसको भी खारिज कर दिया उसको
भी खत्म कर दिया अब मामला वापस से अपील पर
चला जाता है देखिए फिर क्या होता है यहां
पर 2006 में 4 महीने के बाद जब पंजाब और
हरियाणा हाई कोर्ट ने पंजाब सरकार का 1975
वाला नोटिफिकेशन रद्द कर दिया उसके बाद
पंजाब सरकार ने वापस से पंजाब और हा
हरियाणा हाई कोर्ट के खिलाफ जाकर वापस से
एक और एक्ट पास किया पंजाब शेड्यूल कास्ट
एंड बैकवर्ड क्लासेस रिजर्वेशन एंड
सर्विसेस एक्ट 2006 और इसमें भी देखिए वही
चीज की गई 1975 वाले रिजर्वेशन वाले में
आपको याद होगा क्या किया गया था जो
वाल्मीकि और मजहबी सिख कम्युनिटीज हैं
उनको प्रेफरेंस दी गई थी इस वाले एक्ट में
भी वही चीज किया गया लेकिन वापस से देखिए
पंजाब और हरियाणा हाई कोर्ट ने 2010 में
फिर से उसको स्ट्रक डाउन कर दिया और
फाइनली मामला गया पंजाब सरकार ने यह मामला
पहुंचाया सुप्रीम कोर्ट के अंदर और देखिए
2014 में फिर क्या होता है सुप्रीम कोर्ट
ने यहां पर पांच जजों की एक बेंच बैठाई और
उस उनको बोला कि आप देखिए कि क्या 2004
वाला जो फैसला था क्या हमें उसको रिविजिट
करने की जरूरत है क्या उसमें कुछ बदलाव
करने की जरूरत है तो उन पांच जजों ने कहा
कि हां उसमें उसको रिविजिट कर सकते हैं तो
फाइनली इसीलिए यह मामला गया सात जजों के
बेंच के पास क्योंकि 2004 वाला फैसला पांच
जजों के बेंच का था तो अगर कोई फैसला
पलटना है या फिर वही रखना है तो आपका हायर
बेंच के द्वारा उसको किया जाएगा तो सात
जजों का बेंच के पास फाइनली ये ये मामला
गया था जिसका फैसला आज आया है तो आज क्या
फैसला सुनाया गया है जैसा कि मैं आपको
पहले भी बोल रहा था कि इसको लीड किया जा
रहा था हेड किया जा रहा था भाई चीफ जस्टिस
ऑफ इंडिया डी वाई चंद्रचूड़ और 6:1 के
मेजॉरिटी से फैसला आया और इसके अंदर
सुप्रीम कोर्ट ने कहा कि राज्यों को ये हक
मिलता है कि यहां पर अगर वो स्केड्यूल
कास्ट हो या फिर स्केड्यूल ट्राइब हो
उसमें सब कैटेगरी इजेशन करना चाहते हैं
क्योंकि हो सकता है कि देखिए सुप्रीम
कोर्ट का तर्क क्या है आज मैं आपको बताता
हूं सुप्रीम कोर्ट ये कह रहा है कि देखिए
जब से रिजर्वेशन स्टार्ट हुआ है और जिन
लोगों को रिजर्वेशन मिला है जैसे मान लो
एससी के अंदर एसटी के अंदर तो उसके अंदर
जिन लोगों को ऑलरेडी रिजर्वेशन का फायदा
मिल चुका है तो ऑलरेडी वो अपर आप कह सकते
हैं कि वो उनका उत्थान हो गया है तो एक
तरह से अगर राज्यों को लगता है कि
स्केड्यूल कास्ट के अंदर भी बहुत से ऐसे
कम्युनिटीज हैं बहुत से ऐसे लोग हैं जो
रिजर्वेशन का फायदा नहीं उठा पा रहे हैं
तो उनके के लिए राज्य चाहे तो अलग से उसी
के अंदर रिजर्वेशन कर सकती है मतलब
एक्स्ट्रा रिजर्वेशन नहीं देना है उसी
स्केड्यूल कास्ट के अंदर जो 15 पर
रिजर्वेशन है उसमें डिवाइड कर सकती है और
सेम वही चीज शेड्यूल ट्राइब के साथ भी जा
सकता है तो एक तरह से 2004 में सुप्रीम
कोर्ट ने कहा था कि होमोजीनस ग्रुप है
यहां पर सुप्रीम कोर्ट कह रही है कि नहीं
होमोजेनियस ग्रुप नहीं है हम उसमें सब
क्लासिफिकेशन कर सकते हैं हां इसके लिए
क्या है कि राज्यों को कुछ एंपर कल डाटा
दिखाना होगा मतलब राज्य सरकार ऐसा नहीं कि
मनमाने तरीके से जिसको मन चाहा उसके अंदर
सब कैटेगरी इज कर दिया कुछ डाटा के आधार
पर कि इन लोगों को रिजर्वेशन का अभी तक
फायदा नहीं मिल पाया या फिर ज्यादा
डिस्क्रिमिनेशन हुआ है तो उनको यहां पर
रिजर्वेशन सब कैटेगरी इजेशन के अंदर दिया
जाएगा देखिए यहां पर जो इकलौते जज हैं
जस्टिस त्रिवेदी उन्हों उनका ये डिसेंट
जजमेंट था और उन्होंने कहा कि देखिए
राज्यों को यह हक नहीं मिलना चाहिए
