This group robbery- homicide began with
just a lie.
The group robbery-homicide happened in a rural village.
What's the truth of the incident hidden behind the incident?
That was a made-up occured by sloppiness of the Japan police.
Osu Osu! I like girls who don't tell a lie and cheat. I'm Ken chan.
I'm Yami Yamiko.
K : Today's topic is Yakai Incident that was occured by a lie.
K : Make your prediction in comment about which part o the incident is a lie.
K : What kind of incident it was? The scene of the crime was horrific.
Incident Found Out
In 1951, about 70 years ago,
Yakai, Ogo Village is the stage of the incident, where now is named Tabuse Town.
January 25th, around 9:00,
many policemen gathered around the house of the Hayakawas.
Sobe Hayakawa and his wife Hisa, who were both aged 64 at that time, were found in death.
Sobe was stabbed many times and
there was blood everywhere around.
His wife Hisa was found hanged.
Estimated time of death was midnight of the previous day.
According to the scene,
the police judged that a trouble between them made her kill her husband and suicided after that.
But as the investigation went on, a new fact was found.
However all windows of the room where they died in was completely locked,
it's found a floorboard was once removed and set again.
Under the floorboard, there was a mark that a person crawls on the ground.
What's more, money in a chest disappeared.
Based on these facts,
the police judged the incident as a robbery-homicide which is pretended as trouble between them.
The police changed the way of investigation.
In addition, by the scale of the incident, they thought this was done by multiple criminals.
A empty bottle of liquor made the police make sure.
A fingerprint of someone was found on the bottle.
It means the criminal left.
The police didn't miss the little strangeness.
Even the criminals made the detailed forgery,
the criminals made a easy mistake that they left the bottle.
If it's a single criminal who makes a detailed forgery, the criminal must no make that mistake.
The police suspected that this was a carelessness because of multiple criminals' crime.
Y : That's a sharp suspection.
K : They might know that from many years of experiences.
K : Well, was the incident was truly done by multiple criminals?
The police analyzed the fingerprint on the bottle and arrested the one who had the fingerprint.
The one's name is Akira Yoshioka.
In the investigation, he confessed.
Other criminals were arrested to based on his confession.
Shuhei Ato was thought as the princile offender.
He was a close frined of Yoshioka.
Eventually, five people including Ato and Yoshioka were arrested.
They were friends each other.
In bad way, they are actually close.
Why they helped each other and occured the incident?
There were a surprising fact and a lie behind it.
Y : Excellent, the police.
K : Technology was not advanced at that time.
K : So it was important to create and test a hypothesis after investigation of the scene.
K : In this incident, there is a truth hidden.
K : Let's see what happened at the day of the incident.
Truth of the Incident
Midnight of January 24th, the day of the incident,
there was a man who enjoyed Japanese liquor.
He's Yoshioka.
At the table, he decided
to rob money from the Hayakawas.
He was in trouble of money at that time and
heard a rumor abour the Hayakawas.
The rumor was that a lot of money was sent to the Hayakawas from their relatives in Hawaii.
That was just a unreliable rumor.
But that was enough to make him to break in their house and rob money.
It needs guts to break into other's house.
So he drank liquors to get guts.
After he drank, he bought a bottle of liquor and went to their house.
He arrived at their house and it was easy to enter their house.
But after he entered, he noticed what he does is so abnormal.
His hands started shaking.
To settle it down, he gulped down the bottle of liquor and put the bottle at the kitchen.
Y : I know the bottle helped the police arrest him.
Y : But I only can see Yoshioka until now.
Y : Where are other criminals?
K : They will come up later.
He ransacked the house.
Then, he found a chest at their bedroom.
He made sure that the chest has the money and
put his hand on the handle.
At the timing, the husband Sobe woke up.
He was afraid to be found and picked an axe at the kitchen and killed the husband.
In addition, he pressed a futon on the wife and suffocated to death.
After killing, he got a hundred and some dollars from the chest and came up with an idea.
He decided to make forgery to trick the police.
He created the scene that seems a trouble between the husband and wife happened.
But he was caught because of the bottle at the kitchen and
got investigated.
He knew there is no excuse and admitted his guilty.
Y : Wait, wait wait. Other criminals don't show up yet.
K : No, they don't yet. Yamiko san.
K : That's the point of the incident.
As I told you, the police thought this was done by multiple criminals.
So the police questioned him to confess other criminals.
The sudden and unexpected question confused him.
He claimed he did it lonely again and again.
Even thought, the police didn't accept it and
judged he covers other criminals and kept questioning him.
He kept being questioned even he didn't get the question.
But as question went by, he came up with a bad idea.
He got an idea of make-up.
He thought it would be less guilty if there are other criminals and
created non-existent accomplices.
K : This is the truth of the incident.
K : The names he gave was his friends'.
Y : Badass.
K : Yeah, badass.
K : The police's attitude was to justify their own thought.
K : Unconsciously, people tend to justify themselves.
Y : I know that.
K : The mind can be explained by a term.
K : Today's Metler Keyword.[Click]
K : "Cognitive Dissonance"
Cognitive dissonance means discomfort caused by contradiction between thought and action.
Unconsciously, we change our thoughts to fix the discomfort.
There are some who want to sleep early but awake late night.
In this case, the desire to sleep early contradicts the action being awake late night.
Then, how about change the thought that I'm night person?
By thinking I'm night person and I'm better at night,
the one removes the contradiction and alleviates the discomfort.
Then, justification is completed.
K : The policemen who investigated him actually thought
K : there is a contradiction between his testimony and the situation.
K : It resulted in more suspect of the policemen to him.
K : And the coercion of confessions continued.
Nightmare Questioning
Due to his confession, the four including Ato were suddenly suspected as accomplices.
They were betrayed by their friend and suspected for the guilty that they never knows.
They had no time to feel anger and got questioned.
They surely denied comitting the crime.
You watching this channel.
If you are Metler, you would know that
denying is nothing for the police at that time.
For them who kept denying comitting the crime, the policemen started forcing confession.
Long questioning was done everyday.
They were getting trapped mentally and physically.
The questioning escalated.
The policemen slapped them with a baton and burned them with incense stick to force confession.
That was more like torture than questioning.
They lost themselves because of the torture and finally reached their limits.
"It's gonna be better to admit the crime even if it's a lie. We just have to deny it at the court."
In this way, the non-existant accomplices admitted the crime.
As soon as they confessed, the police committed them for trial.
The police announced the detail of the incident to mass media.
His lie and the police's coercion of a confession created the robbery group.
Y : I don't have the experience, so I wonder can't we help confessing under torture?
K : Under extreme condition, people can't have a proper judgement.
K : So the police was bad for sure.
K : Let's not get into the police's bad,
K : their trial began.
K : And the horrible judgement waited for the innocent four.
The Trial
In the first trial, the judgement is based on confession and the crime's brutality.
At first, Shuhei Ato who was made up as a pricnciple offender by Yoshioka's lie.
He didn't accept the police's questioning.
It resulted in death penalty for him.
Other four were judged for life imprisonment.
After that, they went to appeal trial to get less guilty.
At Hiroshima High Court, their trials were taken.
At the court, they couldn't get their wish.
Hiroshima High Court trusted the fact of findings by district court and
judged Ato for death penalty and Yoshioka for life imprisonment.
The court decreased other three's guilty to 15 years of imprisonment.
But they were actually innocent.
They pleaded not guilty and appealed.
But Yoshioka accepted life imprisonment and didn't appeal.
In this way, the man who twisted his friend's lives spent the rest of his life atoning for his sins.
Y : Why he suddenly accepted?
K : I believe he did it because of feelings of guilt that he tricked his friends.
K : But other four's trials last.
K : They appealed but often, it's dismissed.
K : If so, it becomes impossible to decrease the guilty.
K : Then, a savior appeared.
To overcome disadvantageous situation, Ato asked the person for help.
The man was Hiroshi Masaki.
He was a good attorney who had won many the judge of innocence.
Ato sent a letter to the attorney.
Reading the letter, the attorney started the research.
He made sure the four are innocent because he found the four had alibis and
the hanging was possible to be made up.
But as I said, it's often that an appeal is dismissed.
If it's dismissed, the judge becomes solid and
it also becomes impossible to save them.
Then, the great attorney made a surprising action.
He published a book.
He denied dismissal of the appeal by telling the truth to public and getting attention by people.
He published a book named "Judge - Can power take lives away -"
What a great energy the attorney had.
The bood got a big hit.
It was so popular that later, it was made into a movie.
It gathered much attention from people.
The attorney managed to have trials at Supreme Court.
K : Supreme Court couldn't just ignore it because the book told the possibility of innocence.
15th October 1957, four years later,
their trials were back on.
As a result, the police's sloppy investigation and coercion of a confession were recognized by the court.
23rd September 1959,
the judges for them were given.
The judge given to them was innocence.
Hiroshima High Court admitted the crime was lonely done by Yoshioka.
Innocence was given to the four and they finally got free from 8 years and 8 months restraint.
What a long term it is.
Y : About nine years.
Y : It's so long but they finally got free.
K : After the judge, it didn't go well.
K : The police appealed next and they were judged as guilty once.
K : And it was again changed to innocence.
K : It became a long game.
For this Yakai Incident, seven times of trials were done in total and
it's so rare that fact-finding about the incident had changed three times.
It took 17 years until the judge settled down.
The lie Yoshioka told wasted the four's 17 years.
Metler Keyword Cognitive Dissonance The act of justification by changing thoughts to remove anxiety when actions contradicts thoughts.
