  • Can the public take pictures of court records at the courthouse?

-Yes, under Vermont statute, individuals are allowed to take pictures of the computer screen displaying court records at the courthouse, which can be a convenient way to obtain documents without needing a paper copy.

  • What advice is given for using advanced search options when looking for court cases?

-The advice includes using the 'sounds like' feature in advanced filtering options to broaden search results. This is particularly useful if you're unsure of the exact spelling of a name or looking for variations of a name that sound similar.

📚 Introduction to Accessing New England State Court Records

Justin Silverman introduces the third lesson in a series focusing on understanding the courts and access rights under the First Amendment, state law, and court rules, emphasizing the cumulative nature of the series available through the New England First Amendment Coalition (NEFAC). The lesson, supported by entities like the Rhode Island Foundation and SBJ New England, features NEFAC executive committee member and Boston Globe reporter Emily Sweeney, who along with Liam Elder Connors from Vermont Public, will guide viewers through accessing online state court records in Vermont. They address the complexity of accessing these records online due to Vermont's system and statutes but promise to offer tips and workarounds for electronic access, especially for journalists.

05:03

🔍 Detailed Guide on Searching Vermont State Court Records Online

The second segment dives into a step-by-step tutorial led by Liam Elder Connors on navigating Vermont's judiciary website to access court records. Despite the challenging nature of online access in Vermont, Connors demonstrates how to use the Vermont Judiciary's Public Portal to reach Odyssey, the filing system. He explains the filing conventions for civil and criminal cases, showing viewers how to search for cases by year and case type. Additionally, Connors offers tips on understanding the docket sheet, which reveals case details such as events and involved parties, albeit without direct access to documents. For those needing specific documents, he outlines the process of requesting records via a PDF form on the judiciary's website, emphasizing the importance of detailed requests to facilitate the clerks' search and the method for emailing these requests to court-specific addresses.

10:04

📅 Tips for Efficient Document Request and Search Strategies

The final segment elaborates on the practical aspects of requesting court records and searching for cases involving specific individuals. Connors discusses the expected turnaround time for record requests, which varies by court workload but typically ranges from a few hours to a day. He highlights the utility of the 'sounds like' search feature for broadening name searches, a useful tool for journalists investigating cases with potentially misspelled names. Lastly, Connors touches on accessing criminal dockets and the legality of photographing public access terminal screens in courthouses for record keeping. The tutorial concludes with an appreciation for the audience's participation and an open invitation for further questions, underscoring the webinar's aim to demystify the process of accessing Vermont court records online.

Keywords

💡court records

Court records refer to the documents filed in court cases, such as complaints, motions, orders, transcripts, etc. Accessing court records is a key theme in the video, with Liam explaining the process for how to request access to civil court records in Vermont from home. He notes limitations in accessing criminal, family, and probate records remotely.

💡public portal

The public portal refers to the Vermont Judiciary's online system for accessing certain court records. Liam demonstrates searching for cases on the portal and accessing docket sheets. However, downloading full court documents requires physically going to a courthouse to use the public access terminals.

💡Odyssey

Odyssey is the case management system used by the Vermont Judiciary to organize and file court records. Understanding the naming conventions used in Odyssey (e.g. year-case type-5 digit case number) allows for more effective searching for cases.

💡docket sheet

A docket sheet provides a chronological list of all the filings, proceedings, orders, etc. in a court case. Though the full records cannot be downloaded from home, Liam shows how the docket sheets available on the public portal provide useful information on a case.

💡public access terminal

Public access terminals located in courthouses allow viewing and printing of full court records across all case types. Liam contrasts the limited remote access with the broader access available at the courthouses.

💡records request

To obtain full court records remotely, Liam guides viewers through submitting a records request form to the court clerk. This includes details like case number, parties, requested documents, delivery method, etc. He notes receiving records via email within hours or days through requests.

💡search tips

Liam provides various search tips to more effectively find cases on the public portal, such as using broad filters and the "sounds like" feature to catch name variations.

💡First Amendment

Though not emphasized directly, accessing court records relates to principles of open courts and transparency, tied to rights protected under the First Amendment.

💡Limitations

A recurring theme is discussing the limitations and difficulties with accessing Vermont court records remotely compared to being physically present in a courthouse.

💡Workarounds

Given the limitations, Liam focuses much of the instruction on workarounds for obtaining court records from home, such as records requests and search tips.

webinar which is brought to you by the

play01:15

New England First Amendment Coalition

play01:18

this session is going to focus on online

play01:20

access to state court records in Vermont

play01:23

and with us is Liam Elder Connors from

play01:26

Vermont Public Liam thank you so much

play01:29

for being here

play01:30

yeah thanks for having me Emily um yeah

play01:32

so we're going to get right into

play01:34

accessing state court records in Vermont

play01:36

I'm going to show you step by step uh

play01:39

how you can do that in Vermont um I'll

play01:41

say right off the bat um it's a bit

play01:43

difficult there's not actually a great

play01:45

way to say sit at home and access state

play01:49

court records online uh the way Vermont

play01:52

system is set up and the statute is

play01:54

written um you can't really get records

play01:57

immediately but there are some things

play01:58

that I do uh as a reporter who covers a

play02:01

lot of court cases and whatnot to be

play02:04

able to get some electronic access to

play02:06

them so we're just gonna hop in now I'm

play02:10

G to share the screen so the first thing

play02:15

to do is to go to the Vermont

play02:17

judiciary's website which is Vermont

play02:20

spelled out

play02:28

judiciary.com public portal which it's

play02:31

in this second column here when you hit

play02:34

the menu um and the public portal is

play02:38

where we're going to be able to get to

play02:40

Odyssey which is the filing system that

play02:42

Vermont switched to a couple of years

play02:44

ago uh and as you see on this page here

play02:48

there's a lot of different things kind

play02:49

of talking about it um there's this

play02:52

Vermont Judiciary public portal user

play02:54

guide which does have some useful

play02:55

information I'm not going to go on that

play02:57

today I'm going to kind of try to keep

play02:58

this as simple and straightforward as

play03:00

possible uh for folks so if you want to

play03:04

get to the system where you can actually

play03:06

kind of start looking up court records

play03:08

you're going to scroll right down here

play03:09

to this access the public portal button

play03:12

and just click on that public portal say

play03:15

yep continue to leave and it's going to

play03:18

take you here to the public portal page

play03:22

um you do not need to create an account

play03:25

to search in here there you could create

play03:28

an account um that's more useful if

play03:31

let's say you're an attorney or somebody

play03:33

who is not a journalist or general

play03:34

member of the public because you could

play03:36

get elevated access which actually would

play03:38

let you download court cases and court

play03:41

records as just a normal kind of member

play03:43

of the public or a journalist I don't

play03:44

have that elevated access so we're just

play03:46

going to do the normal kind of searching

play03:49

that you can do and you're going to go

play03:51

down to Smart search um and click on

play03:56

that and when you get to that you'll

play04:00

you'll be here and I should also start

play04:03

off by saying that from home I can only

play04:06

search things that are in the Civil

play04:09

courts in Vermont so any criminal case

play04:11

probate Family Court all of those things

play04:13

I can't search from home you can go to a

play04:17

courthouse and all cour houses do have

play04:20

computers they're called Public Access

play04:21

Terminals and from that terminal you can

play04:23

search all court cases around the state

play04:26

including criminal and so what I'm going

play04:29

to try do now is show some tips for

play04:32

using this Odyssey feature from home

play04:34

which you can also then use if you go to

play04:36

the public portal uh at a courthouse and

play04:39

use the access system um things like

play04:41

knowing the the filing conventions

play04:44

essentially for court cases can help you

play04:46

look up things

play04:49

so for looking up a civil case let's say

play04:52

you don't have a specific thing that

play04:53

you're looking for but you maybe want to

play04:55

see what's been filed recently um a

play04:59

little bit of a manual process but the

play05:03

filing convention in Vermont for cases

play05:05

are uh the year the last two digits of

play05:08

the year so in this let's say we're

play05:10

looking for something in 2021 it would

play05:12

be

play05:14

21 Das CV which is for any civil case

play05:18

it's CV for civil it'd be uh CR if it's

play05:22

in criminal court and then another Dash

play05:25

and then five digits and the five digits

play05:28

is the the order in which the cases are

play05:30

filed so let's go to the let's say the

play05:33

10th case filed in 2021 in civil court

play05:36

so it would be uh let's see one two

play05:40

three four five so three zeros and a 10

play05:44

and when you hit

play05:46

submit it should give you great so it

play05:50

will pull up that case and what we can

play05:54

do is we can click on the case and we

play05:57

will actually be able to look at the

play05:59

docket sheet for it which can tell you

play06:01

sort of what records you might want to

play06:04

request so right now you know you can

play06:06

see that it's a let's see what is this

play06:09

it's in Rutland uh it was filed on

play06:12

January 4th

play06:14

2021 it's a credit card collection case

play06:17

um all this information is really useful

play06:19

um and then you can see a little bit

play06:21

more costs of actions the case events I

play06:24

find very useful because it it's a way

play06:26

to kind of check up on civil cases that

play06:28

I'm following or that might be

play06:29

interested in sort of see what recent

play06:31

things have happened and you can see all

play06:33

the different filings as you can see I

play06:34

can't click on any of them if I was at a

play06:36

courthouse there'd be a little uh PDF

play06:39

icon that I could click on and then

play06:41

actually look at those records um but

play06:45

right now I can just sort of see what's

play06:46

been filed you can also see what

play06:48

hearings are coming up um and what

play06:50

happened in those you can see this there

play06:52

was a bench trial that was supposed to

play06:53

happen that got cancelled um and so

play06:56

there's a lot of information here it you

play06:59

can't get the records just by clicking

play07:01

on them but let's say I wanted to get

play07:03

the complaint in this case and I didn't

play07:05

want to drive to a courthouse so now I

play07:08

know what the case number is I also know

play07:12

what the the parties in the case I know

play07:15

when it was filed I know where it was

play07:17

filed I can go back to the judiciary's

play07:19

website which is vermontjudiciary.org

play07:22

I'm going to click on menu again and go

play07:25

to

play07:27

media and

play07:30

when we get to Media we're going to

play07:32

scroll down to records

play07:34

requests requests for access to the

play07:38

court

play07:40

and uh let's see we're going to scroll

play07:43

down all the way to the bottom to this

play07:44

form it's a PDF it's request access to a

play07:46

court record going to open that up in a

play07:49

new

play07:50

tab and as you can see it loads um it's

play07:55

just it's a fillable PDF form that we're

play07:58

going to fill out out so I don't

play08:01

remember where all this was but let's

play08:02

say the case was in

play08:04

Bennington it's a civil case it's 21-

play08:10

cv- 2222 whatever it is and then just

play08:13

fill out your info about yourself you

play08:15

know my name phone number uh the kind of

play08:21

case it is you don't necessarily need to

play08:23

put the case type in here um it can help

play08:26

but if you have the case number and the

play08:28

name of the case that's going to help

play08:30

out the clerk they're going to be able

play08:31

to find it no problem so I would usually

play08:33

just fill out that information the kind

play08:37

of information you're looking for maybe

play08:39

I want the whole file if I know that I

play08:41

just want a spec a specific document

play08:43

I'll say I just want the

play08:46

complaint then you would click

play08:48

electronic

play08:50

certification which means they'll send

play08:52

it to you by email requested delivery

play08:55

method email fill out the date signature

play08:59

I usually just do a you know two slashes

play09:01

put my name there and then uh then save

play09:06

this PDF title it you know records

play09:09

request and the docket number for it and

play09:12

so once you have that you're going to

play09:13

email the court there's a lot of steps

play09:15

here I know it's kind of cumbersome but

play09:16

this is frankly the the best way I have

play09:19

you know from home of getting access to

play09:21

court records um so once I filled out

play09:23

that form I'm going to go back to the

play09:24

Vermont judiciaries page and scroll back

play09:29

up up to email addresses for all the

play09:31

courts and you click on

play09:34

that and this will tell you all the

play09:36

email addresses for all the courts um so

play09:39

this one is in Bennington copy and paste

play09:42

that and email them the subject line is

play09:45

actually valuable and and in this is

play09:47

that you want to make sure it goes to

play09:48

the right division of the whatever Court

play09:51

you're requesting to so in this case

play09:52

it's civil so in your subject line you'd

play09:55

put the docket sheet uh you know let's

play09:58

say it was in Bennington Bennington

play10:00

Civil Division I usually also put in

play10:02

like records requests in all capitals

play10:04

either at the front or at the back end

play10:05

of this just to make sure it gets

play10:07

flagged and then the time that it takes

play10:11

for them to get back to you can can

play10:13

change a little bit um different courts

play10:15

and depending on how busy it is it might

play10:17

take a little longer or shorter but I

play10:18

usually get things within a couple of

play10:20

hours to a day at most um so it's a

play10:23

pretty quick turnaround time and can be

play10:24

useful if let's say you're not on an

play10:27

intense deadline um and that you maybe

play10:29

just sort of need to uh you know get

play10:33

something if you're fishing around and

play10:34

are interested in a case it's a good way

play10:36

to sort of gather uh documents there

play10:40

so that's generally a way of of doing it

play10:44

it's a little cumbersome but um all of

play10:48

these sort of search skills are

play10:49

applicable if you go into the public

play10:51

portal um I want to go back to the uh to

play10:56

our web page sorry about that the uh

play11:00

uh where is it I'll go back to the

play11:04

public portal and just sort of talk a

play11:06

little bit about Goods sort of search

play11:07

tips if you're looking for names of a

play11:09

person um because that can also be a

play11:11

little

play11:12

tricky um so we're going to go back to

play11:16

the public portal going to

play11:19

continue smart

play11:21

search

play11:24

um and generally you know it's last name

play11:27

first name middle name suffix um and you

play11:31

know that can be good so let's say let's

play11:33

see if there's anything for me right in

play11:38

civil nothing I don't have any civil

play11:41

court cases thankfully um but let's say

play11:45

you're pretty sure that the name of a

play11:48

person involved in a case that you're

play11:49

looking for his pretty sure his name is

play11:51

Liam maybe not totally sure uh a feature

play11:54

that I really like to use is I go to

play11:57

advaned filtering options

play11:59

I generally leave you know all locations

play12:01

I don't really I want it to be as broad

play12:03

as possible and I'll scroll down to

play12:07

sounds like and this will sort of give

play12:09

me names that are close to what I'm

play12:12

searching and this can be kind of a good

play12:14

way to broaden your searches if you're

play12:16

pretty sure that you know a person who's

play12:18

involved in a case but that they're not

play12:21

coming up for whatever reason so once

play12:22

you hit that and hit

play12:27

submit we're going to it gets Connor's

play12:29

Leon uh Connor's Lynn so as you can see

play12:33

sort of it it's sounds like Liam Connor

play12:35

it's not exactly um and I've used that

play12:37

before in reporting about um rental

play12:41

housing and trying to find cases that

play12:43

were filed by uh tenants against the

play12:46

landlord and small claims court and I

play12:47

was using the sounds likee feature to

play12:49

sort of broadly look to make sure I

play12:52

wasn't missing any of this landlord's

play12:54

various like llc's or or his different

play12:57

you know if his name was one thing or or

play12:59

different thing depending on how the

play13:01

tenant filed it so that that's kind of a

play13:05

a good like tool that I like to use when

play13:07

I'm uh searching

play13:09

cases um so those are those are kind of

play13:12

the big things that you can do if you're

play13:15

trying to get access to Vermont court

play13:17

records from home um again this same

play13:22

system this aicy system here it's going

play13:24

to look just like this if you go to a

play13:26

courthouse uh and use the public access

play13:28

terminal there it's it's going to have

play13:31

all of the same stuff except you'll be

play13:32

able to search the criminal docket as

play13:35

well which um is useful and then you can

play13:37

click on the filings you can either

play13:40

print them out and you know pay a fee to

play13:43

get a copy of them but you can also what

play13:45

I do sometimes is I'll take a picture of

play13:47

the computer screen with my phone that

play13:49

is allowed under Vermont statute that is

play13:52

not going to be a problem and it can be

play13:54

a good way if you're just sort of you

play13:56

know not sure if you need a paper copy

play13:58

but still want to have a copy there as

play14:00

well um so those are the big those are

play14:03

the big things on accessing Vermont

play14:06

court records online I wish sometimes it

play14:08

was a little a little simpler but um

play14:11

yeah that is that's what we got Liam

play14:13

play14:16

guiding us through how to get uh court

play14:19

records in Vermont I appreciate it happy

play14:21

to do it and people feel free to follow

play14:23

up if they have any more questions even

play14:25

play14:27

anytime all right excellent all right
