wurden und welche Daten die schufer
dafür genutzt hat das neue Gesetz
schiebt dem nun einen regiel vor denn
das ist eine weitere Neuerung die nun
eingeführt wird so heißt es im Absatz 4
im neuen Paragraphen konkret und ich
fasse zusammen an der Stelle auf Antrag
der betroffenen Person müssen in
präziser transparenter verständlicher
und leicht zugänglicher Form in einer
klaren und einfachen Sprache mitgeteilt
werden welche personenbezogenen Daten
für das Scoring verwendet wurden welche
Gewichtung Kategorien und Kriterien
dabei hatten und welche Aussagekraft das
Scoring hat und welche Werte an welchen
Empfänger übermittelt wurden also
wirklich viele Dinge die die schufer in
Zukunft offenlegen muss und für den
Einzelfall sogar genau begründen muss
bislang lehnte das z.B die schufer trotz
des Urteils vom EGH in der Regel ab und
es geht noch weiter im Absatz 6 der
regelt näm nicht dass betroffene
Verbraucher zukünftig ein Recht auf
Anfechtung Darlegung des eigenen
Standpunktes und Entscheidung einer
jetzt kommt es nämlich natürlichen
Person haben also nicht einfach nur ein
Algorithmus der das entscheidet und das
hat natürlich weitreichende Konsequenzen
denn in der Regel werden die Millionen
Datensätze der schufer und auch von
anderen auskunftteilen ja maschinell
verarbeitet und aktualisiert und auch
der Scorewert oder wie im Gesetz genannt
Wahrscheinlichkeitswert wird
automatisiert errechnet im Zweifelsfall
muss also dann ein Mensch den scorwert
festlegen und auch begründen können und
nicht mehr nur die Maschine und ein
Algorithmus außerdem dürfen
auskunftteinen wie z.B die schufer in
Zukunft ausdrücklich keine Daten mehr
von Minderjährigen Personen speichern
und verwerten wichtig der neue Paragraph
37a im Bundesdatenschutzgesetz betrifft
dabei nicht ausschließlich die schufer
sondern auch andere auskunftteilen die
Schufa ist aber natürlich im Alltag der
Verbraucher mit die entscheidenste
auskunftteil aber auch die Kreditreform
und andere müssen nun Umdenken des
Weiteren können sich auch noch Details
ändern aktuell hat sich das
Bundeskabinett zwar auf diese Inhalte
des Gesetzesentwurfs geeinigt aber durch
die Beratung und Entscheidung im
