tentang sumber hukum Islam
syariat dan fiqih syariat dalam makna
luas merupakan hukum Allah yang mengatur
perbuatan manusia apabila merujuk pada
makna Syariah pada Quran surat
al-jatsiyah ayat 18 syariat dapat
dipahami sebagai agama yang Merupakan
sekumpulan aturan yang menjadi jalan
hidup dan dapat menuntun manusia menuju
kebahagiaan dunia dan akhirat syariat
atau hukum Allah sifatnya kekal karena
merupakan ketentuan Allah dan Rasulullah
Shallallahu Alaihi Wasallam syariat
bersifat tunggal dan fundamental dengan
kata lain syariat adalah dasar ajaran
Islam yang satu tetapi dapat
menghasilkan keragaman pemahaman
pemahaman atau hasil interpretasi
manusia terhadap Syariat disebut fiqih
untuk menghasilkan sebuah pemahaman
diperlukan seperangkat aturan atau
metode yang disebut sebagai Ushul Fiqh
dalam ilmu fiqih dikenal banyak masa
fiqih setidaknya ada 4 masa fiqih yang
dikenal oleh masyarakat Islam Indonesia
yaitu Mazhab Syafi'i Hanafi Hambali dan
Maliki keempat Masa fiqih ini memiliki
produk pemahaman fiqih yang berbeda
selain karena perbedaan lingkungan hidup
dan spesialisasi keilmuan setiap Imam
penggunaan metode dan pengambilan dalil
pun menjadi penyebab perbedaan produk
fiqih yang dihasilkan tujuan hukum Islam
sebagaimana yang dirumuskan oleh Abu
Ishaq al-syatibi bahwa semua ajaran atau
hukum Islam merujuk pada 5 tujuan yaitu
yang pertama tujuan menjaga agama
beragama merupakan salah satu fitrah
manusia dengan memiliki agama manusia
memiliki jalan untuk mengenal Tuhan
memiliki petunjuk hidup mendapatkan
nasihat memiliki jalan untuk mendapatkan
ketentraman dan kebahagiaan dan
seterusnya yang kedua menjaga diri
menjaga diri merupakan tujuan hukum
Islam yang sangat menghargai kehidupan
larangan untuk menghilangkan nyawa tanpa
alasan yang dibenarkan secara ketentuan
kisah dan diet sebagai hukuman dari
pembunuhan menunjukkan bahwa nyawa
manusia sangat berharga untuk menjaga
diri juga Islam memerintahkan manusia
untuk mengonsumsi makanan yang halal dan
Toyib atau baik yang ketiga ada menjaga
akal menjaga akal merupakan
dengan hukum Islam yang menghendaki
terjaganyakal sehat menjaga akal bukan
berarti menjaganya dari kerusakan tetapi
juga dengan mengasah dan memanfaatkannya
belajar merupakan salah satu perintah
agama yang bertujuan untuk menjaga akal
Selain itu menggunakan akal untuk
mengembangkan ilmu pengetahuan juga
sangat diharapkan oleh Islam yang
keempat ada menjaga harta menjaga harta
merupakan tujuan hukum Islam yang
menghendaki terjaganya hak-hak
kepemilikan harta salah satu hukum
dengan tujuan hifsu Alma diungkapkan
Quran surah al-maidah ayat 38 yang
menyatakan bahwa pencuri yang mengambil
harta milik orang lain harus dipotong
tangannya hukum potong tangan tersebut
diserukan saat seorang berusaha
mengambil harta yang bukan merupakan
hartanya yang kelima ada menjaga
keturunan Islam mensyaratkan pernikahan
sebagai salah satu sarana untuk
menyalurkan kebutuhan seksual dan naluri
untuk memperoleh keturunan pernikahan
ini disyaratkan untuk menjaga kejelasan
garis keturunan seorang anak serta
terjaminnya pemenuhan hak-hak pengasuhan
serta pendidikan seorang anak dari orang
tuanya Selain itu Islam juga
mensyaratkan hanya keturunan yang
dihasilkan dari pernikahan yang sahlah
yang boleh mendapatkan harta waris dari
orang tuanya sumber hukum Islam yang
kedua adalah Alquran Alquran merupakan
kitab suci yang diturunkan kepada Nabi
Muhammad Shallallahu Alaihi Wasallam ada
keberadaannya menjadi penyempurna
kitab-kitab terdahulu itu bukti
kesempurnaan Alquran dibanding kitab
terdahulu menurut nikolis Majid terdapat
dalam Qur'an surat as-syura ayat
39-43 dari ayat tersebut Alquran
mengharapkan adanya keseimbangan dalam
berbuat Apabila seseorang di zolimi maka
ia berhak membalas sebanyak perbuatan
zalim yang diterimanya akan tetapi di
saat yang bersamaan memaafkan perbuatan
zalim lebih dicintai oleh Allah
selanjutnya adalah sejarah Alquran
setidaknya terdapat tiga ayat yang
menunjukkan waktu turunnya Alquran yaitu
Quran surat al-baqarah ayat 185 Quran
surat al-qadr ayat 1 dan Quran surat Ad
Dhuha ayat 3 lalu mengenai turunnya
Alquran yang dimaksud dalam 3 ayat
tersebut para ulama berbeda-beda
pendapat Sebagian ulama termasuk IBN
Abbas menafsirkan bahwa yang dimaksud
oleh ketiga Ayat tersebut adalah
turunnya Alquran secara bersama-sama
dari Lauhul Mahfudz ke Baitul Izza oleh
malaikat pada malam yang diberkati atau
lailatul qadar barulah setelah itu
Alquran diturunkan secara
berangsur-angsur dari Baitul Izzah
kepada Rasulullah Shallallahu Alaihi
Wasallam selama kurang lebih 23 tahun
Sebagian ulama lagi termasuk Al Syafi'i
berpendapat bahwa turunnya Alquran di
malam Lailatul tersebut adalah permulaan
turunnya Alquran kepada Rasulullah
Shallallahu Alaihi Wasallam
selanjutnya adalah cara memahami
kandungan Alquran terdapat empat cara
untuk memahami kandungan Alquran yaitu 1
cara munasabah dan kajian tematik Muna
ini merupakan keterkaitan kata dengan
kata ayah dengan ayat dan surat dengan
surat dalam Alquran terutama dari segi
makna munasabah ini sangat penting
diperhatikan karena sebuah Alquran dapat
dipahami dengan melihat ayat lainnya
oleh karena itu dalam memahami ayat
Alquran tidak boleh dilakukan secara
parsial jadi harus menyeluruh
dari ayat yang sebelumnya dan ayat yang
setelahnya
cara yang kedua adalah kajian Hadits
tema pada saat Rasulullah masih hidup
umat Islam meminta penjelasan Alquran
langsung kepada Rasulullah Shallallahu
Alaihi Wasallam baik dari perkataan
perbuatan dan ketetapan Rasulullah
Shallallahu Alaihi Wasallam itulah yang
disebut sebagai hadits hadits memiliki
fungsi penjelasan perincian dan
penguasaan terhadap ayat-ayat Alquran
lalu cara yang ketiga adalah kajian
bahasa Alquran diturunkan dalam bahasa
Arab bukan semata-mata karena biasanya
para nabi berasal dari bangsa-bangsa di
Timur Tengah tetapi Salah satu alasan
Alquran diturunkan dalam bahasa Arab
adalah karena kekayaan bahasa Arab itu
sendiri dan cara yang terakhir adalah
asbab Al nuzul sebab turunnya ayat
AlQuran asbab al-musul merupakan kajian
sejarah berupa baik peristiwa khusus
yang melatarbelakangi turunnya Sebuah
ayat atau konteks sosial budaya yang
terjadi pada masa Sebuah ayat turun
pengetahuan asbab Al nuzul penting untuk
diketahui khususnya untuk memahami
ajaran inti dari ayat Alquran dan
kesesuaian konteks zaman Alquran
diturunkan dengan konteks saat ini
hadits merupakan segala sesuatu yang
berhubungan dengan Rasulullah
Shallallahu alaihi wasallam yang
disampaikan oleh para sahabat terdiri
dari tiga bagian yaitu sanad Matan dan
mukhoriq sanad merupakan rangkaian para
perawi atau periwayat hadits sanad
selalu berada di bagian depan hadis yang
berisi nama-nama periwayat Matan atau
isi hadits merupakan informasi utama
yang disampaikan oleh sebuah hadits
boharit adalah perawi terakhir yang
membukukan sebuah hadis
selain hadis nabi ada juga Hadits Qudsi
Hadits Qudsi merupakan kalam Allah yang
bukan Alquran dengan parafrase dari Nabi
Muhammad Shallallahu Alaihi Wasallam
mudahnya hadis adalah hal-hal yang makna
dan lafalnya berasal dari Rasulullah
sementara Hadis Qudsi lafalnya dari
Rasulullah dan maknanya berasal dari
Allah
macam-macam hadis satu berdasarkan
jenisnya terdapat hadits qauliyah hadits
fi'liyah dan hadis taqririyah hadits
qauliyah merupakan hadis yang berisi
perkataan Rasulullah hadits fi'liyah
merupakan hadis yang berisi informasi
perilaku rasulullah hadits taqririyah
merupakan persetujuan Rasulullah
terhadap suatu perbuatan yang dilakukan
sahabat atau seseorang dihadapannya atau
perbuatan seseorang di tempat yang lain
dilaporkan kepada beliau lalu Beliau
diam yang kedua berdasarkan kuantitas
terdapat Hadits mutawatir dan hadis Ahad
Hadits mutawatir merupakan hadis yang
diriwayatkan oleh 10 perawi atau lebih
di setiap tingkatan perawinya sementara
hadits Ahad merupakan hadis yang
periwayatnya tidak mencapai 10 orang
yang ketiga berdasarkan kualitas
terdapat Hadits Shahih hadits Hasan dan
hadits dhaif Hadits Shahih merupakan
hadis yang memenuhi 5 kaidah kekuatan
Hadits Shahih sangat tinggi Terlebih
jika secara kuantitas diriwayatkan
secara cara Mutawatir hadis Hasan
merupakan hadis yang memenuhi 5 kaidah
tersebut hanya kualitas keadilan dan
hafalan perawi tidak setinggi Hadits
Shahih hadits dhaif merupakan hadis yang
tidak memenuhi kalimat kaidah tersebut
misalnya terputus sanadnya kualitas
perawi yang rendah memiliki
yang keempat berdasarkan muatan risalah
terdapat hadis risalah dan gais risalah
hadits risalah merupakan hadis yang
muncul saat Nabi Muhammad Shallallahu
Alaihi Wasallam berperan sebagai Rasul
atau pembawa risalah hadis gairisalam
merupakan hadis yang muncul saat posisi
Rasulullah Selain sebagai pembawa
risalah posisi hadits terhadap Alquran
pertama taqib dan taqrir berkedudukan
menguatkan dan menegaskan hukum-hukum
yang terdapat dalam Alquran yang kedua
Bayan memberi penjelasan terhadap hukum
yang terdapat dalam Alquran penjelasan
tersebut dapat berupa Menjelaskan arti
yang masih samar merinci hal-hal yang
disebutkan Alquran Secara garis besar
membatasi hal-hal umum yang disebutkan
Alquran memperluas hukum yang disebut
dalam Alquran yang ketiga isbat dan
insya hal ini sangat berguna untuk
menjangkau audience yang lebih luas
cara memahami sebuah hadis ada lima Yang
pertama kualitas hadis apabila hadis
tersebut memiliki kualitas yang tinggi
Shahih atau Hasan maka dapat digunakan
sebagai sumber hukum Islam akan tetapi
apabila memiliki kualitas yang lemah
atau dive maka hadits tersebut tidak
dapat dijadikan sebagai landasan hukum
yang kedua Kajian Hadis tertema
mengumpulkan hadis lain yang memiliki
topik yang sama Dalam Memahami sebuah
hadis menjadi sangat penting yang ketiga
asbab al-hurad merupakan peristiwa
khusus yang melatarbelakangi munculnya
sebuah hadits atau kondisi sosial budaya
yang berkembang saat kemunculan sebuah
hadits yang keempat kajian kebahasaan
dan yang kelima jenis Hadits ijtihad 1
landasan hukum ijtihad merupakan sumber
hukum Islam yang ketiga setelah Alquran
dan Hadis Ijtihad dilakukan dengan
mengerahkan segenap akal sehat
pengetahuan dan kemampuan Analisis untuk
membuat hukum yang tidak disebutkan
secara eksplisit dalam Alquran dan hadis
2 ijma ijma merupakan kesepakatan para
ahli yang berkompeten dalam mengurusi
umat tentang sebuah hukum setelah masa
Nabi Muhammad Shallallahu Alaihi
Wasallam orang yang melaksanakan ijtihad
disebut dengan mujtahid Di mana orang
tersebut adalah orang yang ahli tentang
Alquran dan hadis dalam sebuah ijma
terdapat unsur-unsur yang merupakan
rukun ijma salah satunya yaitu adanya
sejumlah orang yang berkompeten sebagai
mujtahid 3 kias kias merupakan salah
satu cara penggunaan Dayu dalam menggali
hukum yang tidak disebutkan secara
eksplisit dalam Alquran dan hadis dengan
cara membandingkan dengan sebuah hukum
yang ada di dalam Alquran dan hadis hias
merupakan metode ijtihad utama yang
digunakan oleh Imam Syafi'i penerapan
hukum Islam Salah satu tugas manusia
sebagai khalifah adalah menegakkan hukum
Allah Subhanahu Wa pemula di muka bumi
sebagai seorang muslim Indonesia kita
juga kerap dihadapkan pada pertanyaan
Bagaimana batasan penerapan hukum Islam
di lingkungan tempat kita hidup pada
penerapan hukum Islam dalam arti luas
terlebih dahulu harus dipisahkan antara
urusan akidah dan ibadah serta urusan
keseharian atau muamalah contoh
penerapan hukum Islam adalah hukum
potong tangan bagi pencuri sebagaimana
yang diungkapkan dalam Quran surah
al-maidah ayat
38-39 bagi masyarakat Arab hukuman
maksimal yang paling menyerahkan bagi
pencuri adalah potong tangan hukum
tersebut dapat berubah di setiap waktu
dan tempat disesuaikan dengan kondisi
yang berlaku
meskipun Indonesia tidak menerapkan
hukum Islam secara menyeluruh seperti
Arab Saudi atau Qatar namun pada
dasarnya nilai-nilai yang terkandung
dalam Islam juga diterapkan dalam hukum
positif Indonesia Hal ini dapat dijumpai
dari berbagai peraturan
perundang-undangan yang mengandung
nilai-nilai hukum Islam diantaranya
undang-undang Nomor 1 Tahun 1974 tentang
perkawinan sebagaimana diubah dengan
undang-undang nomor 16 tahun 2019
tentang perubahan atas undang-undang
Nomor 1 Tahun
1974 tentang perkawinan yang kedua
undang-undang Nomor 7 tahun
1989 tentang Peradilan Agama sebagaimana
diubah dengan undang-undang nomor 3
tahun 2006 tentang perubahan atas
undang-undang nomor 7 tahun
1989 tentang Peradilan Agama dan kedua
kali dengan undang-undang nomor 50 tahun
2009 tentang perubahan kedua atas
undang-undang nomor 7 tahun
1989 tentang Peradilan Agama yang ketiga
undang-undang nomor 41 tahun 2004
tentang wakaf yang keempat undang-undang
Nomor 21 Tahun 2008 tentang perbankan
syariah yang kelima undang-undang nomor
23 tahun 2011 tentang pengelolaan zakat
yang keenam undang-undang nomor 8 tahun
2019 tentang penyelenggaraan ibadah haji
dan umroh yang ketujuh undang-undang
Nomor 18 tahun 2019 tentang pesantren
yang ke-8 Instruksi Presiden Nomor 1
tahun 1991 tentang penyebarluaskan
