le chiedo subito di cominciare a raccontarci che cos'è il tso
un saluto a tutti voi
parliamo dei trattamenti sanitari obbligatori
il tso è un trattamento sanitario definito obbligatorio
l'ASO invece è un accertamento sanitario obbligatorio
ogni intervento sanitario sia di prevenzione di cura di riabilitazione
ha il suo fondamento nel riconoscimento dei diritti fondamentali dell'uomo quindi
della libertà della dignità dell'informazione e quindi anche del consenso
quindi il trattamento sanitario obbligatorio e l'ASO
sono delle procedure
che vanno un po' oltre questi fondamenti
Ci puoi quindi inquadrare il contesto di riferimento legislativo
in cui ci muoviamo?
il contesto normativo
parte addirittura dalla costituzione della repubblica italiana sia l'articolo
13 che dichiara che la libertà personale è inviolabile e l'articolo 32
che stabilisce che la salute è un diritto di ogni cittadino
ma è anche un interesse della collettività quindi ha una duplice valenza
inoltre stabilisce che nessuno può
essere sottoposto a un trattamento sanitario al di fuori del consenso del
soggetto se non per disposizione di legge.
E la legge a cui dobbiamo fare riferimento nel caso specifico è la 833 del 78
la legge 833 che è stata un po' il superamento di quello che prima era la
manicomializzazione delle patologie mentali prevede in maniera molto chiara
che è possibile effettuare dei trattamenti sanitari obbligatori
o accertamenti sanitari obbligatori per malattia mentale
solo in alcune precise specifiche situazioni.
Ti chiederei ora le condizioni in cui si
applica il tso.
In merito al tso in degenza ospedaliera
la procedura può essere avviata esclusivamente quando si realizzano
contestualmente tre condizioni ovvero: 1) alterazioni psichiche tali da richiedere
urgenti interventi terapeutici 2) questi interventi vengono rifiutati dal
paziente proprio per le alterazioni psichiche e
3) non sussistono le condizioni per attuare delle alternative
terapeutiche al di fuori del contesto ospedaliero.
Queste condizioni devono
essere valutate da due medici: un proponente ed un convalidante
La legge dice che è bene che il convalidante sia un medico
del sistema sanitario nazionale. A livello europeo si è sancito in qualche
modo che il convalidate sia proprio uno psichiatra
Qual è la procedura del tso?
In quanto procedura medico legale fino ad adesso
abbiamo visto tutta la parte medica adesso subentra invece quella legale
nel senso che nel momento in cui un medico valuta e riconosce la necessità di un
trattamento sanitario obbligatorio redige un primo certificato
a questo punto un secondo medico convalida quanto proposto dal collega e
redige un secondo certificato. I due certificati vengono inviati al sindaco
del comune in cui è avvenuto il trattamento sanitario obbligatorio
in quanto massima autorità sanitaria del comune, a garanzia dei cittadini
il sindaco ha 48 ore di tempo per valutare, rendersi conto delle condizioni
e disporre l'ordinanza di trattamento sanitario obbligatorio
a quel punto in cui viene redatta l'ordinanza il paziente viene
effettivamente ricoverato in una struttura ospedaliera
nello specifico in un SPDC
e cosa fa a sua volta il sindaco? Invia una copia dell'ordinanza
anche al giudice tutelare che ha a sua volta 48 ore di tempo
per valutare le condizioni
in cui è avvenuto il TSO ed eventualmente
anche revocare o convalidare l'ordinanza del sindaco
A questo punto il tso è diventato a tutti gli effetti una procedura medico-legale
e la durata del tso sarà di 7 giorni.
Può essere rinnovabile anche il periodo?
Due cose: può essere sia rinnovato qualora al termine dei
sette giorni sussistano ancora le tre condizioni che abbiamo detto prima
oppure può essere anche prima revocato cioè se prima dei sette giorni
viene meno uno dei tre elementi in particolar modo nel momento in cui il
paziente riconosce la necessità di proseguire dei trattamenti sanitari
viene meno la sussistenza della obbligatorietà
e si può revocare il tso e passare un trattamento sanitario volontario.
Grazie mille per averci spiegato così
nel dettaglio il trattamento sanitario obbligatorio perché comunque è una
procedura abbastanza complessa e dalle tue parole sicuramente si è esemplificato un
po' anche il contesto in cui ci stiamo muovendo ti chiederemmo poi di
raccontarci che cos'è l'ASO.
L'aso è un accertamento sanitario obbligatorio dove
si rende necessario non il trattamento come il tso, ma l'accertamento
cioè diventa in qualche modo obbligatorio la valutazione di una persona
di un cittadino il provvedimento dell'ASO è attuabile
quando si rende necessario venire in contatto con una persona che
evidentemente si sta sottraendo alla valutazione
per comprovate alterazioni psichiche tali da rendere necessario e direi quasi indispensabile
una valutazione.
Quindi è possibile che familiari, vicini di casa,
piuttosto che servizi sociali vengano a conoscenza di alterazioni psichiche
di una persona per cui ritengono opportuno che uno psichiatra
valuti appunto questa questa situazione il soggetto si sottrae, non si rende reperibile
e quindi a questo punto si può segnalare questa condizione ai servizi psichiatrici
ma non solo a qualsiasi medico lo si può fare anche al medico di famiglia
al medico della continuità assistenziale quindi alla guardia medica
l'importante è avere comprovate
situazioni di questo tipo: è necessario che non sia stata una segnalazione qualsiasi,
ma una serie di segnalazioni e anche attentamente descritte e valutabili
quindi cosa succede? queste segnalazioni
arrivano a qualsiasi medico e se ci sono queste condizioni si può procedere
ad attuare un accertamento sanitario obbligatorio
Sì, mi ricordo quando Zapparoli parlava di "follia pubblica e follia privata"
segnalava il fatto che un paziente psichiatrico
arriva all'attenzione delle altre persone
quando questa follia diventa pubblica e avendo lavorato con te so bene
che questo tipo di procedura viene attivata quando c'è
magari il vicino di casa che non ne può più perché sente la puzza piuttosto che
il vicino di casa che chiama perché sente degli schiamazzi
o il paziente che sta magari urlando sul balcone alle 3 di notte
diciamo che l'ASO veramente è uno strumento importante di accertamento sanitario
il cui primo passo avviene proprio dalle persone che vivono il
contesto del paziente che magari non hanno un'idea di cosa sta succedendo ma
che sono preoccupate per questo paziente
e ci sono anche all'interno
della psichiatria delle psicopatologie per cui pazienti si sottraggono
non c'è niente da fare
perché la consapevolezza di malattia
magari è scarsa e quindi ci sono delle situazioni in cui bisogna proprio
intervenire in altro modo che non sia il modo canonico di chiamare il paziente e
convocarlo, ovviamente.
Ti posso chiedere quali sono le condizioni in cui si applica l'ASO?
proprio in merito a quello che dicevi sottolineo questo
aspetto della non consapevolezza di malattia
se la legge 833 ha in qualche modo stabilito bene quali siano le deroghe
a quelli che sono gli articoli della costituzione
è proprio perché vi sono nelle alterazioni psichiche nella patologia mentale
purtroppo questa componente della scarsa consapevolezza di malattia
che inevitabilmente potrebbe portare il soggetto a un peggioramento
a una non cura a non rispettare quel quel diritto alla salute
perché gli viene meno la possibilità di riconoscerne il bisogno.
Invece in merito alla procedura
anche in questo caso abbiamo bisogno di certificati
il certificato di proposta di un accertamento sanitario obbligatorio
viene redatto da un qualsiasi medico che sia venuto a conoscenza
e che abbia delle prove consistenti
della necessità di obbligare un cittadino alla
valutazione psichiatrica, il certificato redatto viene consegnato a
mezzo dei vigili urbani al sindaco così come accaduto anche per il tso e il
sindaco ha 48 ore di tempo per emanare l'ordinanza di aso.
A questo punto quello che accade è che con l'ordinanza
le forze dell'ordine ed i vigili urbani contattano il paziente e lo accompagnano nella sede
in cui viene stabilita la possibilità di effettuare la valutazione psichiatrica
Ecco immagino che l'ASO possa avere un esito:
negativo se
l'accertamento sanitario in realtà non aveva necessità poi di trattamento successivo
oppure potrebbe essere invece un esito invece più positivo
laddove il paziente ha bisogno di un trattamento e quindi può sfociare per esempio in un
trattamento sanitario volontario oppure in un trattamento sanitario ospedaliero
Le possibilità sono più o meno queste appunto durante la valutazione lo
psichiatra valuta e si rende conto che non è necessario nessun trattamento
dà altre indicazioni
o in base alle necessità oppure viene valutata necessità di un trattamento
e il paziente accetta o qualsiasi intervento di cura il paziente accetta il paziente viene rivalutato
magari anche ambulatorialmente oppure viene proposto
un trattamento, viene rifiutato, e a quel punto si può rientrare nelle condizioni
per procedere con un trattamento sanitario obbligatorio
ok alla luce di quanto ci hai spiegato ci hai raccontato
ci hai parlato delle tre condizioni
per cui viene effettuato un trattamento sanitario obbligatorio
chiaramente io credo che questo sia cambiato anche nel tempo
se noi pensiamo alla primissima legge sul trattamento sanitario obbligatorio
nel 1904 era stata pensata proprio per
un pezzo sulla pericolosità sociale quindi l'idea era che quel paziente
fosse pericoloso socialmente quindi il trattamento sanitario veniva fatto
proprio per richiudere quel potenziale " pazzo" perché poteva fare del male a
qualcuno qui si sta parlando invece di una
situazione molto diversa come ci hai già raccontato tu anche in base proprio al
principio e al diritto di salute quindi al diritto di cura che se viene
rifiutato perché ci sono delle condizioni psicopatologiche che non
permettono la consapevolezza
di capire che effettivamente a quel paziente a quella
persona ne ha bisogno comunque devono essere effettuate
quindi le condizioni psicopatologiche più frequenti
mi immagino che siano riferibili ai
disturbi gravi di personalità a situazioni di psicosi conclamata
ma soprattutto anche a delle anomalie comportamentali me lo confermi?
Esatto
diciamo che le alterazioni psichiche tali da richiedere urgenti trattamenti
sanitari sono di solito le quelle che vengono definite i disturbi maggiori
possiamo considerare le gravi alterazioni del comportamento e
quindi che possono in qualche modo poi se non effettuate nell'immediato
essere lesive per se stessi o per gli altri,
oppure anche scompensi psicotici
nei quali viene meno proprio la consapevolezza di quello che è la natura
del proprio malessere oppure le gravi depressioni,
quindi
tutti i disturbi maggiori
Dobbiamo proprio segnalare anche i casi
per esempio di anoressia grave quando per esempio dei pazienti sono
proprio a rischio da un punto di vista nutrizionale.
Esatto e anche in quel caso
ormai un po' tutti i dipartimenti hanno un po' meglio sviluppato vari
protocolli per quanto riguarda i trattamenti sanitari, sono stati inclusi
anche quelli per l'anoressia
perché l'anoressia è riconosciuta appunto come un' alterazione psichica
viene meno la consapevolezza
della propria patologia.
Alla luce della nostra esperienza anche lavorativa
insieme possiamo confrontarci un po' su un aspetto che secondo me poi per gli
psicologi è sempre fondamentale cioè l'idea che il trattamento sanitario
obbligatorio ma anche l'accertamento sanitario obbligatorio proprio per la
procedura e come si sviluppa
( c'è di mezzo la forza dell'ordine magari c'è
di mezzo l'ambulanza e per la caratteristica di obbligatorietà)
sono delle procedure comunque che vanno a minare un terreno che è quello della
fiducia all'interno della relazione terapeutica noi sappiamo che sia
da psicologici che da psichiatri uno degli strumenti fondamentali del nostro lavoro
è sicuramente l'alleanza terapeutica
il tso e l'aso sono degli strumenti
assolutamente invasivi rispetto a questa relazione quindi
volevo chiederti un po' rispetto alle criticità che si possono sviluppare.
La criticità effettivamente più importante riguarda il minare la
relazione terapeutica e quell'alleanza che un po' deve scontrarsi con la
frustrazione dell'andare contro la volontà del paziente
dall'esperienza ma in generale
anche dalla poca letteratura che c'è in merito
effettivamente c'è una componente di
sofferenza e di dolore perché nella procedura
c'è la parte che abbiamo visto dei certificati
ma poi c'è anche quella pratica delle forze dell'ordine
che in qualche modo obbligano quindi c'è anche a volte una componente
anche un po' di conflittualità fisica e la necessità di passare alla componente
coatta del trattamento che è sicuramente dolorosa e va riconosciuta
come tale
però soprattutto per quanto riguarda il trattamento sanitario obbligatorio
quello che possiamo vedere è che
nell'ambito di quel trattamento e quindi di quel ricovero ospedaliero
c'è la possibilità per il paziente di rielaborare il proprio malessere durante il ricovero
continua ad effettuare colloqui con i medici, con gli psicologi
a confrontarsi con tutta l'équipe sanitaria, con gli infermieri
e quindi quel momento frustrante
traumatico e doloroso ha la possibilità giorno per giorno di essere
rielaborato nel dialogo nella rivalutazione di quello che è accaduto
del proprio malessere esperito
e di quelle condizioni che hanno in qualche modo
determinato, indotto il il trattamento sanitario obbligatorio
e nella maggior parte dei casi
quello che accade è che a risoluzione di quella acuzie psichiatrica
il paziente in qualche modo riconosce il beneficio
dell'essere uscito da quella fase acuta
e della necessità in qualche modo del trattamento
sanitario obbligatorio
con tanta fatica con tante difficoltà
però in parte un po' riconosce quel quel bisogno
è pur vero che sicuramente le istanze a volte persecutorie del paziente
possano essere proiettate sul curante
e qui può esserci una frattura lo si mette in
conto è una possibilità...
All'interno della relazione tso a volte
parlo da terapeuta
viene vissuto come un fallimento del proprio lavoro terapeutico
e questo può portare a un effetto che poi diventa deleterio
cioè quello di "abbandonarlo" in spdc
dirò una cosa scontata però laddove dovesse
succedere che un paziente subisca un tso la cosa importante del terapeuta è di
comunque continuare a contattarlo magari andarci a vederlo
sembra scontato
ma poi nella quotidianità non è così scontato anche perché dobbiamo fare
i conti con la nostra frustrazione personale e professionale
però è uno degli elementi più importanti per ricucire quella che può diventare
una frattura e se diventa una frattura poi è un problema come ricucirla
veramente
Indubbiamente sia per gli aspetti proprio normativi del tso
fatto da due medici un proponente un convalidante,
che appunto assicura la possibilità di un confronto
e di una valutazione che non sia monocratica ma fatta da un'équipe
ma generalmente nei servizi psichiatrici territoriali quello
che si fa è lavorare in équipe nel senso che lì dove un paziente dovesse
presentare una condizione di questo tipo non è soltanto il curante un solo medico
che prende una decisione ma se ne discute si cerca anche di trovare altre alleanze
si cerca di dare spazio anche laddove è possibile ad un lavoro di équipe
quindi anziché essere soltanto in un'unica direzione diretta la frustrazione
può essere utile un po' allargare e ampliare
l'équipe anche per questo motivo
