🏢 Israel Defies UN Court Order on Gaza Assault

The International Court of Justice (ICJ) has issued a legally binding order for Israel to cease its military operations in Rafah, Gaza, as part of a wider genocide case initiated by South Africa. Despite the ICJ's authority, it lacks enforcement mechanisms, leading to skepticism about the order's effectiveness. Israel has previously disregarded ICJ rulings and continues to intensify its assault, citing the need to disarm Hamas. The situation in Gaza worsens with the potential for famine, and the ICJ also ordered the reopening of the Rafah border crossing to allow aid. Israeli officials have condemned the ICJ's ruling, arguing they are defending against Hamas, and some Israelis agree with this stance. The discussion raises questions about the impact of the ICJ's orders and the potential consequences for Israel's international standing.

👥 Expert Opinions on Israel's Compliance with ICJ Ruling

In a panel discussion, various perspectives are shared regarding Israel's potential compliance with the ICJ's ruling. Muhammad D, a lawyer, suggests that Israel may reconsider its actions due to the clarity of the ICJ's order and the risk of arrest warrants for Netanyahu and other officials. Alan Neel, a former Israeli diplomat, provides Israel's perspective, indicating they view the order as not to inflict harm on civilians and may continue operations under certain interpretations. William Schabas, an international law expert, finds Israel's potential non-compliance preposterous, given the clarity of the ruling. The conversation also touches on the possibility of the UN Security Council becoming involved and the implications of international pressure on Israel.

10:01

🛡️ Israel's Justification and International Criticism

The panelists discuss Israel's justification for rejecting ICJ orders and the ensuing international criticism. Alan Neel explains that Israel interprets the ICJ's orders in a way that allows it to continue operations, focusing on the protection of its civilians. However, the panelists agree that this interpretation may not hold globally. The conversation also highlights the growing international pressure on Israel, including potential isolation and the impact on its diplomatic relations. The Israeli public's reaction to this pressure is mixed, with some being concerned about the consequences of non-compliance and others adopting a more indifferent stance.

15:03

🚨 Challenges of Enforcing ICJ Ruling and UN Investigative Access

The discussion turns to the challenges of enforcing the ICJ's ruling, particularly in allowing UN investigators into Gaza. Muhammad D explains that Israel maintains strict control over Gaza's borders, making it unlikely that investigators will be granted access. The panelists also consider the broader implications of Israel's defiance, including its impact on the genocide case and the potential for arrest warrants to be issued against Israeli leaders by the International Criminal Court (ICC).

20:04

🌐 International Implications and US Dilemma

The conversation explores the international implications of Israel's defiance of the ICJ's orders, especially for the United States, which has been a staunch supporter of Israel. The panelists discuss the potential for the situation to escalate to the UN Security Council, where the US might face a difficult decision regarding its support for Israel. The discussion also touches on the broader implications for international law and the potential for other states to take non-violent countermeasures against Israel.

25:06

🔄 Potential Shifts in Israel's International Standing

The final part of the discussion considers the possibility of Israel reevaluating its stance in light of increasing international pressure and isolation. The panelists weigh in on the potential for Israel to face consequences if it continues to defy international rulings and the impact this could have on its international standing. The conversation concludes with a reflection on the critical juncture Israel faces in deciding between pursuing security at the expense of its international reputation or finding a diplomatic solution.

Keywords

💡International Court of Justice (ICJ)

The International Court of Justice (ICJ) is the principal judicial organ of the United Nations (UN), established to settle legal disputes between nations and to provide advisory opinions on legal questions referred to it. In the video's context, the ICJ has issued an order for Israel to cease its military operations in Rafah, Gaza, as part of a case brought by South Africa accusing Israel of genocide. The ICJ's rulings are final and legally binding, but it lacks enforcement mechanisms, which raises questions about the effectiveness of its orders in this situation.

💡Genocide

Genocide refers to the deliberate and systematic destruction of a racial, political, or cultural group. In the video, South Africa has brought a case against Israel to the ICJ, accusing it of committing genocide in Gaza. The term is significant as it frames the severity of the alleged actions and the international legal response required to address such crimes.

💡Rafah

Rafah is a city located in the southern part of the Gaza Strip. The city is central to the video's narrative as the ICJ has ordered Israel to halt its military operations specifically in this area. Rafah has been a focal point of conflict, with Israel citing the need to dismantle Hamas as a justification for its actions there.

💡Hamas

Hamas is a Palestinian Islamic organization that governs the Gaza Strip. In the video, Israel claims it is intensifying its assault on Rafah to dismantle Hamas, which it views as a terrorist organization. The mention of Hamas illustrates the complex political dynamics at play in the conflict and the reasons Israel provides for its military actions.

💡Legal Binding

The term 'legal binding' refers to a ruling, decision, or agreement that is enforceable by law and must be obeyed. The ICJ's orders are described as final and legally binding in the video, indicating that Israel is obligated under international law to comply with the court's directives to cease military operations in Rafah.

💡Enforcement

Enforcement in the context of the video pertains to the mechanisms by which the ICJ's orders are carried out or compelled. Despite the ICJ's rulings being legally binding, the court lacks its own enforcement capabilities, leading to discussions in the video about the effectiveness of international law and potential consequences for non-compliance.

💡Humanitarian Aid

Humanitarian aid refers to the assistance provided for humanitarian purposes, often in situations of disaster, conflict, or poverty. The ICJ ordered Israel to allow humanitarian aid into Gaza through the Rafah border crossing. This highlights the dire humanitarian situation in Gaza and the international community's concern for the well-being of its inhabitants.

💡Diplomatic Isolation

Diplomatic isolation refers to a state's lack of diplomatic relations or being shunned by other nations. In the video, there is a discussion about the potential for Israel to face increased diplomatic isolation due to its actions in Gaza and the international community's response, including the possibility of more countries recognizing Palestine.

💡International Criminal Court (ICC)

The International Criminal Court (ICC) is an international tribunal that sits in The Hague in the Netherlands and is intended to prosecute individuals for international crimes of genocide, crimes against humanity, and war crimes. The video mentions the ICC in relation to the potential issuance of arrest warrants against Israeli leaders, which would further complicate Israel's international standing.

💡United Nations Security Council

The United Nations Security Council is one of the six main organs of the UN and is charged with ensuring international peace and security. It has the power to enforce the rulings of the ICJ, as discussed in the video. The US, as a permanent member of the Security Council, has the ability to veto resolutions, which puts it in a difficult position if the ICJ's rulings are brought before the Council.

💡State Sovereignty

State sovereignty is the principle that each state has the highest authority over its territory and that no other state or entity has the right to interfere in its domestic affairs. The video touches on the concept of state sovereignty in the context of Israel's actions in Gaza and the international community's response, raising questions about the limits of sovereignty when it comes to human rights and international law.

play00:37

hello and welcome to the program I'm

play00:39

fuli batibo the international court of

play00:41

justice has ordered Israel to stop its

play00:43

assault on Rafa the order is one of

play00:46

three issued by the un's top Court in

play00:48

the genocide case brought by South

play00:50

Africa against Israel over its war on

play00:53

Gaza Israel has long declared it plans

play00:55

to intensify its assault on the southern

play00:57

city saying it's necessary to dism Hamas

play01:01

and it appears it plans to follow

play01:02

through with that strategy the icj's

play01:04

rulings are final and legally binding

play01:07

but it doesn't have a way to enforce

play01:09

them so does this latest order carry any

play01:12

weight and will it affect events on the

play01:15

ground and how will prime minister

play01:16

Netanyahu manage increased pressure at

play01:18

home and abroad we'll explore these

play01:20

questions with our guests in just a

play01:22

moment but first this report by K Lopez

play01:28

hyan it's a signific ific an move for

play01:30

the un's top Court a landmark emergency

play01:34

ruling ordering Israel to stop its

play01:36

assault on Rafa Israel must immediately

play01:39

hold its military offensive and any

play01:43

other action in the Rafa Governor which

play01:46

may inflict on the Palestinian group in

play01:48

Gaza conditions of life that could bring

play01:51

about its physical destruction in whole

play01:54

or in

play01:55

part but shortly after the international

play01:58

court of justice issued its ruling

play02:00

Israeli forces intensified their attacks

play02:03

wiping out entire

play02:05

neighborhoods the ruling is part of a

play02:08

wider legal case that began with South

play02:10

Africa accusing Israel of genocide in

play02:13

Gaza many Palestinians doubt any of the

play02:16

Court's orders will change things or

play02:18

stop the government of Israeli Prime

play02:20

Minister Benjamin Netanyahu from moving

play02:23

forward with the

play02:26

offensive I hope Israel will comply but

play02:28

it hasn't cared about Court's rulings or

play02:31

even its allies in the

play02:33

past Israel will continue the massacres

play02:36

Israel is a state above the law and no

play02:38

one can stop

play02:40

it as part of the ruling Israel was

play02:43

ordered to reopen the Rafa border

play02:45

crossing and allow Aid into Gaza famine

play02:49

is already affecting parts of the North

play02:51

and the World Health Organization says

play02:53

it can spread across the strip

play02:57

fast Israeli officials have condemned

play02:59

demed the icj's ruling the government

play03:02

says it's defending itself and fighting

play03:04

Hamas and some Israelis agree the fact

play03:08

that they're even having this

play03:09

conversation is quite ludicrous to be

play03:11

honest I think that we have women young

play03:14

women we have men we have elderly

play03:16

individuals that have been taken hostage

play03:19

and while Israel is a signatory to the

play03:22

Geneva conventions the icj has no means

play03:25

to enforce its orders many analysts now

play03:28

question whether the ruling like other

play03:30

legal motions will be dismissed by

play03:33

Israel and if so if there will be

play03:36

consequences states can choose to take

play03:39

countermeasures uh against other states

play03:41

uh non-violent counter measures would

play03:43

include things like economic sanctions

play03:45

for example um in order to induce

play03:47

enforcement all of that depends

play03:48

obviously on the the political will in

play03:51

the

play03:52

situation for now Palestinians in Gaza

play03:55

must wait to see if the icj's court

play03:57

orders will extend beyond

play04:00

words kope oan Al jazer for insight

play04:09

story well let's now bring in our guests

play04:12

for today's show joining us in occupied

play04:14

East Jerusalem is mammed D who is a

play04:16

lawyer and a founder of an East

play04:18

Jerusalem Law Firm that practices in the

play04:20

Israeli and Palestinian legal systems in

play04:23

Tel Aviv Alan Nel a former Israeli

play04:25

Diplomat who served as Israel's

play04:27

ambassador to South Africa and in London

play04:29

William shabas he's an international law

play04:32

expert and a professor at middle sex

play04:34

University gentlemen thank you for

play04:36

joining us on inside or a warm welcome

play04:38

to all of you uh Muhammad D if I can

play04:40

start with you a legally binding order

play04:42

from the international uh court of

play04:44

justice for Israel to stop its offensive

play04:47

on Rafa are you at all hopeful the

play04:49

Israelis will heed this call at some

play04:52

point in time so far it doesn't seem to

play04:54

be the

play04:56

case yeah it hasn't been the case but I

play04:59

think that the Israeli Army and that the

play05:01

Israeli government cannot continue to

play05:02

ignore international law in this case a

play05:05

specific

play05:07

International court order this is a a

play05:10

clear order this time and it talks about

play05:13

a specific area the the RAF area and I

play05:17

think that this time with

play05:20

the warrant orders the the arrest orders

play05:24

by the IC also waiting for bam Netanyahu

play05:28

and Galant I think that the Israeli

play05:30

government will think twice this time

play05:32

when they decide on their future actions

play05:35

in Rafa so it's not it it is Bing Israel

play05:39

hasn't been following international law

play05:41

in the past but I think with this

play05:43

current order they will uh they will

play05:46

they will treat it in a different way I

play05:48

don't think that the Israeli government

play05:49

can continue to violate international

play05:53

law can continue not to comply with

play05:56

orders issued by the international court

play05:58

of justice the high highest court in the

play06:01

world and get away with it I think this

play06:03

time they know that the time has come

play06:05

for Israel really to comply with these

play06:07

orders and to comply with the

play06:10

international law and if they don't do

play06:12

so then the risks of uh arrest warrants

play06:16

for the two gentlemen that we spoke

play06:18

about and maybe others the risk is is

play06:21

getting higher and higher okay Alan Neel

play06:24

your thoughts will Netanyahu completely

play06:26

ignore this order will the Israeli

play06:29

government continue to defy the highest

play06:31

court of international

play06:33

law in Israel the interpretation is

play06:38

different ER the Israeli government sees

play06:42

the order as to stop the violence once

play06:47

or if it is inflicting damage on

play06:51

civilians and the Israeli government say

play06:54

we are not

play06:55

inflicting any damage or casualties on

play06:58

civilians

play07:00

and will go on with a war in Rafa ER I

play07:05

think although Israel has a different

play07:08

interpretation it'll be very cautious

play07:11

especially when it comes to

play07:14

civilians but I don't think Israel

play07:16

intends to end the

play07:18

war H what can H maybe force Israel to

play07:23

do so is if these orders go to the UN

play07:28

Security Council

play07:30

for another vote and we'll need another

play07:33

American veto then a new procedure will

play07:37

start okay I'll ask you a little bit

play07:39

more about what we can expect at the UN

play07:41

Security Council in a moment let me

play07:42

bring in William shabas into the

play07:43

conversation uh William Alan leel says

play07:46

there is in Israel that there's a very

play07:48

different interpretation of this law but

play07:50

as Muhammad D said it's it's a very

play07:53

clear order this time from the

play07:54

international court of justice a very

play07:57

specific ruling unlike the two previous

play07:59

this once the court is ordering Israel

play08:01

to stop the the military operation in

play08:04

Rafa to allow humanitarian Aid in

play08:06

through Rafa and other Crossings how

play08:09

much weight does this ruling carry uh

play08:12

despite Israel ignoring previous rulings

play08:14

of the

play08:16

Court well I totally agree I think the

play08:18

ruling uh and the order from the court

play08:21

couldn't be much clearer than it is and

play08:23

the the idea that Israel can interpret

play08:26

this in some way that allows it to

play08:28

continue with its military offensive is

play08:31

is quite Preposterous and I think the

play08:33

whole world will will see that um of

play08:36

course it's clear now that Israel

play08:38

doesn't intend to comply with it

play08:40

whatever uh whatever contrived

play08:42

interpretation it develops about the

play08:44

order and as as everyone knows there is

play08:47

not an enforcement mechanism as such the

play08:50

enforc what's the purpose then of these

play08:52

measures William shabas if they're going

play08:53

to be ignored well you don't know that

play08:56

they're going to be ignored until you

play08:57

order them and I think that for most

play08:59

countries who've been on the receiving

play09:01

end of these orders historically they do

play09:04

comply with them and so South Africa has

play09:06

no alternative it has to go to the court

play09:08

to get the orders um and then hopefully

play09:12

political pressure will be put on Israel

play09:14

to get it to comply already we're seeing

play09:16

the consequences on Israel uh with many

play09:19

of its allies and Friends many of the

play09:21

countries that have been very supportive

play09:23

and friendly to Israel are losing their

play09:25

taste for this um partly because they

play09:28

also value and and respect the

play09:31

international court of justice they

play09:33

can't stomach Israel's attitude of of

play09:37

absolute disdain for an order by a court

play09:40

Israel accepted this Israel never had to

play09:42

ratify the genocide convention but once

play09:44

it did it opened the door to orders from

play09:47

the international court of justice and

play09:49

it it is it is obliged to respect them

play09:52

Alan how does Israel continue to justify

play09:55

rejecting these orders from uh the

play09:57

international court of justice is Israel

play09:59

Above the

play10:01

Law no I explained how Israel justifies

play10:05

it it takes the word if it may inflict

play10:09

and so on but H the headlines in the

play10:13

world are that the court ordered Israel

play10:17

to end the operation in Rafa and

play10:20

definitely this will trigger more

play10:24

criticism some of it probably in the UN

play10:28

and some of it

play10:29

bilaterally I don't think this

play10:32

International court of justice order is

play10:36

standing on its own you have

play10:39

simultaneously several things happening

play10:43

now in Israel's pH relations that are

play10:47

causing what we call here a tsunami or a

play10:51

diplomatic tsunami and Israel has to

play10:54

look at the wider picture definitely we

play10:57

are losing support in more and more

play11:00

parts of the world especially in Europe

play11:03

now that is seen as very important to us

play11:06

yeah certainly Alan leel this has been a

play11:08

bad week for Israel How concerned are

play11:10

Israelis about this growing

play11:12

International pressure and this growing

play11:13

International isolation it's not just

play11:15

this latest ruling by the international

play11:17

court of justice it's also the ICC

play11:19

seeking to issue arrest warrants against

play11:22

uh Israeli leaders and also Hamas

play11:23

leaders and some very important European

play11:25

countries as you mentioned who are now

play11:27

demanding uh that an independent

play11:29

Palestinian State be established how

play11:31

does this resonate with the Israeli

play11:33

public at

play11:35

large the Israeli public is not too

play11:38

concerned unfortunately an attitude was

play11:42

developed with most of the Israel public

play11:46

that no matter what we do the world will

play11:49

be against us as the world is by

play11:52

definition

play11:54

anti-semitic so there is a tendency to

play11:57

overlook what's happening in the

play11:59

International Community on the other end

play12:01

many Israelis are really really worried

play12:05

that if H we end the war Hamas will have

play12:08

a comeback and will attack us again

play12:12

so this is the the feeling in the public

play12:17

however netan will be the one making the

play12:20

decision he he can decide on its on his

play12:23

own he has in his cabinet some ministers

play12:27

say let's go the diplomatic way others

play12:31

are pushing for the military way and he

play12:33

has to the side yeah all right Muhammad

play12:36

Dal your thoughts about this Alan Neel

play12:38

says there a different interpretation of

play12:40

this latest ruling by Israel and the

play12:43

Israel views these decisions made uh at

play12:45

the international uh level as

play12:47

anti-semitic what do you make of

play12:51

this well I think as you know Israel has

play12:54

sent a judge adhoc judge Barack who is

play12:59

part of the international court of

play13:00

justice and I think now Israel is trying

play13:04

basically to base its case on his

play13:07

descending opinion in his opinion he

play13:09

tried to say that actually the

play13:12

international court of justice is not

play13:15

ordering a total freeze of the military

play13:19

offense in Rafa but actually it it does

play13:22

so with certain conditions that if they

play13:25

are met uh then Israel uh should stop

play13:29

the operation but if Israel doesn't

play13:32

inflict this

play13:34

physical damage to the Palestinian civil

play13:37

population then the operation can

play13:40

continue so that's the expl explanation

play13:42

that Barack in his opinion when it was

play13:46

issued that what he actually presented

play13:49

to the Israeli government to the Israeli

play13:51

attorney general basically giving advice

play13:53

to the Israeli Army yet reading the

play13:56

decision uh of the 13 judges in the

play13:59

court they say that actually there is no

play14:03

way to uh operate in Rafa without

play14:08

inflicting this damage on the civilian

play14:10

population they mentioned what Israel

play14:12

has tried to do with the several

play14:14

hundreds Palestinians that they

play14:15

evacuated from Rafa to al- maasi area

play14:19

and other areas and they the court says

play14:21

in its ruling that those areas are not

play14:24

adequate for habilitation people cannot

play14:27

really live there there are no houses no

play14:29

water no sewage nothing therefore the

play14:32

interpretation given by the Israelis I

play14:34

think will not be accepted by anybody in

play14:36

the world but that's the that's how

play14:38

Israel got away with it until now all

play14:41

the time Israel has its own

play14:43

interpretation to international law

play14:45

including International humanitarian law

play14:48

and that was only an Israeli

play14:50

interpretation that was different from

play14:52

what the World Scholars think about

play14:55

International humanitarian law briefly

play14:57

Muhammad Dal before I bring uh William

play14:59

back into the conversation the ruling

play15:00

also says Israel has to allow un

play15:02

investigators into Gaza uh to to

play15:05

investigate the genocide case right

play15:07

what's the likelihood of that happening

play15:09

of Israel allowing investigators into

play15:11

the

play15:13

territory it hasn't allowed in the past

play15:16

several un inquiry commissions were

play15:20

supposed to come to the Palestinian

play15:21

territories in the past based on

play15:23

different uh resolutions of the United

play15:25

Nations General Assembly uh human rights

play15:29

Council or other committees and Israel

play15:32

in the past hasn't been cooperative and

play15:35

this time I don't think it's going to be

play15:36

any different Israel this is actually

play15:38

this this shows the case of Gaza Gaza

play15:41

has been besieged Gaza is still under

play15:44

isra full control from the sea from the

play15:48

air and uh from the the border the

play15:51

territorial borders no one can enter

play15:53

Gaza without an Israeli permit or an

play15:56

Israeli consent and Israel is the only

play15:59

one who decides who comes and who goes

play16:01

out of Gaza

play16:03

therefore I think that the Israelis will

play16:05

not allow the the the you know the

play16:08

investigators to come in so far they

play16:10

haven't been able to do that even Karim

play16:12

Karim Khan the the the Attorney General

play16:16

of the IC was not able to enter Gaza he

play16:18

only came to the ra Cross Point and but

play16:22

he was not able to get to get inside

play16:24

Gaza he visited the Israeli kuim inside

play16:27

Israel but he wasn't was n able to get

play16:30

inside Gaza although he got the

play16:31

information from other un agencies but

play16:34

entering into Gaza is a totally

play16:36

different story so unlikely to happen

play16:38

all the time is hindering that unlikely

play16:40

to happen then William uh will a

play16:44

Defiance of this order uh my

play16:46

understanding is that uh there's no

play16:48

immediate sanction for violating the

play16:50

provisional orders issued by the uh

play16:52

International court of justice but does

play16:54

the ruling have broader implications for

play16:57

the genocide case that Israel is

play17:01

facing well in principle it doesn't it's

play17:04

a preliminary ruling about an urgent

play17:07

situation and it's without prejudice as

play17:09

we lawyers say to the merits of the case

play17:13

but clearly the attitude and the

play17:15

violence it's we we consense the

play17:18

attitude of the judges already I I think

play17:21

Israel's approach in reading this order

play17:23

in this very technical Manner and

play17:26

suggesting that somehow it allows them

play17:27

to continue with business as usual is

play17:30

really not a reading in good faith you

play17:32

have to read the judgments you have to

play17:34

read what the other members of the Court

play17:36

have said in their individual opinions

play17:38

and one cons sense that this is a court

play17:41

that is getting more angrier and angrier

play17:44

and and more and more impatient with

play17:46

Israel so Israel is not heading into a

play17:48

good place in this case of course

play17:51

there's going to be a great debate when

play17:53

this finally goes on the merits but it's

play17:56

not it's not looking good for Israel in

play17:58

terms of its future at the international

play17:59

court of justice what about at the

play18:01

international criminal court will a

play18:03

Defiance of this order by Israel affect

play18:06

the pre-trial chamber of the ICC which

play18:08

is currently debating whether to issue

play18:10

arrest warrants against Israeli

play18:12

leaders not technically of course not

play18:15

because it has no the the two are not

play18:18

directly related in any way but uh again

play18:21

what we can see here listen there are 13

play18:23

judges of the court from all over the

play18:26

world from countries that are friendly

play18:28

to Israel as well as countries that are

play18:31

perhaps less friendly to Israel and

play18:33

they're unanimous about this we can

play18:35

expect the same kind of sentiment the

play18:37

same kind of mood amongst the three

play18:39

judges at the pre-trial chamber of the

play18:41

international uh Criminal Court who are

play18:43

going to have to rule in the coming

play18:45

weeks on the prosecutor's application

play18:47

for the arrest warrants of course we

play18:49

can't foresee what they'll decide but

play18:52

this sets the tone and I I think we we

play18:55

can anticipate that those arrest

play18:57

warrants will be issued and there are

play18:59

all kinds of other sort of soft effects

play19:01

of this that go outside of the legal

play19:03

sphere altogether and we've made

play19:05

reference to them already the fact that

play19:07

there's an increasing number a growing

play19:09

momentum of states to recognize

play19:11

Palestine as a state and probably open

play19:15

the door still the United States is an

play19:18

obstacle but it's the last only the last

play19:20

obstacle to admitting Palestine as a

play19:22

full member state of the United Nations

play19:25

right and Muhammad I'll ask you about uh

play19:27

about this the us being this obstacle uh

play19:29

but let me just uh get Alan neel's

play19:31

thoughts about what uh uh William said

play19:34

there I mean what happens Alan if these

play19:37

arrest warrants are issued Israel's

play19:39

credibility has uh radically diminished

play19:42

within the course of this war on Gaza

play19:43

there's a shifting perception today in

play19:45

the world of Israel as a law abiding uh

play19:49

democracy what would it mean for Israel

play19:51

to lose that status and to be treated as

play19:53

a non-democracy

play19:56

oh as far as I remember remember uh

play20:00

124 countries members of the

play20:03

international criminal court H will have

play20:07

to arrest netan and Gallant our Minister

play20:11

of Defense if orders are issued so this

play20:17

definitely is quite an embarrassment and

play20:20

quite a complication to our H for

play20:25

relations Israel will try to undermine

play20:29

it

play20:30

legally ER the visits to the United

play20:34

States are still possible even if orders

play20:37

will be issued because the United States

play20:39

is not a member of the

play20:42

IC I think at this stage from all the

play20:46

discussion the issue that is the most

play20:49

urgent one in Israeli eyes is if it will

play20:53

reach the security Council because as

play20:56

far as I understand every one of the 15

play21:00

members of the security Council can now

play21:03

pull it to a discussion there and in the

play21:07

security Council it'll be very difficult

play21:10

for the United States to vote against a

play21:13

verdict or an order of the international

play21:16

court of justice so in a way we are

play21:20

complicating the international situation

play21:24

of the United States If It Moves again

play21:26

to the security Council so a lot is

play21:30

happening

play21:31

simultaneously

play21:32

definitely embarrassing to Israel

play21:35

embarrassing to Israel Muhammad D only

play21:38

the security Council has the power to

play21:39

enforce these rulings by the

play21:41

international court of justice but as

play21:43

we've heard from both uh William and

play21:46

Alan there it's likely that the the US

play21:49

will veto uh any moves at the security

play21:52

Council so what then should be done to

play21:55

uh enforce uh these rulings and and how

play21:58

difficult a position does this put the

play22:00

US in I mean they've backed Israel uh

play22:02

through in throughout this conflict how

play22:05

difficult will it be for them if this

play22:07

gets to the security

play22:10

Council I think it puts the United

play22:12

States in a very difficult position I

play22:14

mean for how long can the the the US use

play22:17

the veto to rescue Israel from its

play22:20

troubles and from the troubles that they

play22:22

are putting the United States in as well

play22:25

and we're not talking about the IC now

play22:27

we have heard what the Israelis are

play22:28

asking the the US Administration to do

play22:31

to the IC attorney general and to the

play22:34

judges and to the employes at the IC

play22:37

they want them to sanction the court we

play22:40

haven't heard such a thing ever I mean

play22:43

asking the superpower to sanction an

play22:46

international court for issuing or for

play22:49

issuing a motion only for the time being

play22:52

uh to ask for an arrest warrant for war

play22:55

criminals uh this is UN unheard of un

play22:58

think of but now we are moving to the

play23:00

ICC and the ICC is an organ of the

play23:03

United Nations and the United States is

play23:05

part of that of that order it's part of

play23:09

the IC it's part of the United Nations

play23:12

unlike the sorry it's part of the

play23:15

icj which the United States is not part

play23:17

of it it's not the United States in a

play23:20

very awkward position uhuh uh and and

play23:24

and and basically saying that this uh

play23:27

you know world or order that we

play23:29

established after the second world war

play23:31

which includes the UN Charter and it

play23:34

includes the international court of

play23:36

justice and so many other International

play23:39

covenants and conventions and agreements

play23:42

that are supposed to regulate relations

play23:45

between peoples between countries

play23:47

between states that those are actually

play23:49

are not applicable in the case of Israel

play23:52

the United States has been under a huge

play23:55

embarrassment for its treatment to

play23:57

Israel in this current conflict not now

play24:00

only but throughout the years and now

play24:03

it's in in really a very very bad

play24:05

position if it continues to use that

play24:08

veto because it's going to be clear for

play24:10

all the International Community that

play24:12

that this move is against international

play24:15

law and against International jti let me

play24:18

get William's thoughts about this

play24:19

William how much does this heighten the

play24:20

cost for the Biden Administration as it

play24:23

continues to be Israel's sole guarantor

play24:25

and Defender and what are the next steps

play24:27

as far as International law is concerned

play24:29

I mean they what are the obligations of

play24:31

third States in this

play24:33

case you know I wouldn't underestimate

play24:36

the ability of the United States to be

play24:39

hypocritical on these subjects the

play24:40

United States has been keenly supporting

play24:43

the international criminal court when

play24:45

it's investigating the Russians in

play24:47

Ukraine despite the fact that it claims

play24:50

that the court has no jurisdiction over

play24:52

people who aren't citizens of a member

play24:54

State now of course they're raising that

play24:56

objection and they're going to be uh

play24:59

trying to take measures apparently to

play25:01

block the work of the court it's not the

play25:03

first time they've done it they tried

play25:05

back in 2002 when it looked like the

play25:07

Rome statute was going to enter enter

play25:09

into Force which it did of course and

play25:12

then they tried under the Trump

play25:13

Administration but these were really

play25:15

quite pathetic efforts that had no teeth

play25:17

in them uh in in reality they had very

play25:19

little in the way of practical

play25:21

consequences and and I don't see that

play25:24

they thought up anything brilliant since

play25:25

then that could actually inflict pain

play25:28

it's a annoyance it's an annoyance

play25:30

disgraceful that they're doing it but

play25:32

but it's not going to stop the

play25:34

international criminal court proceeding

play25:36

with what what it is set up to do okay

play25:39

uh Alan leel is Israel and the Israeli

play25:41

government likely to reevaluate its

play25:43

position uh in the face of intensifying

play25:46

international pressure and intensifying

play25:52

isolation uh it's a difficult question

play25:56

because uh um

play25:58

I don't know if this wave will continue

play26:02

but if it will continue if both courts

play26:06

the IC and icj will go on with the

play26:10

pressures if the security Council will

play26:13

go on voting if more European countries

play26:16

will recognize Palestine if it will end

play26:19

up with the America in a

play26:23

certain time not

play26:25

Ving then Israel will have to listen

play26:29

I think we are at a critical Junction if

play26:33

we give up on our International standing

play26:37

and focus on our security or if we go

play26:41

after 100%

play26:44

security because of the pressure of the

play26:47

Israeli population the Israeli

play26:50

government will have to decide if to go

play26:53

now the military way or the Diplomatic

play26:55

way thank you gentlemen for a very
