For the first time since 1994, opposition parties have secured chairperson positions in the Free State Legislature due to a significant drop in the ruling ANC's support to 52%. The legislature, which consists of 30 members, saw the ANC reduced to six seats, while the opposition holds 40. After negotiations, the Democratic Alliance (DA) and Economic Freedom Fighters (EFF) each obtained one chairperson position, leading to a more consensus-based dynamic within the legislature. The ANC had to reduce one of their cabinet positions to gain an additional seat in the legislature, but still couldn't fill all required positions. The DA's Roy Janilson expresses optimism for the future, as the legislature is now better equipped to hold the executive accountable.

🚨 Cross-Border Crime and Its Impact on the Free State

Janilson addresses the serious issue of cross-border crime, including smuggling, cattle rustling, human trafficking, and drug trafficking, which have significant economic and social impacts. play00:08

today we look at how National political

play00:11

developments have affected provincial

play00:14

rule in the Free State and we speak to

play00:16

Roy janilson the Democratic Alliance

play00:19

leader in that Province welcome Roy good

play00:21

morning Chris thank you Roy what

play00:24

happened last week we had an

play00:27

interesting event that took place last

play00:30

week and that is that for the first time

play00:33

opposition parties this is since

play00:36

1994 have received chairpersonship of

play00:40

committees within the Free State

play00:43

Legislature and that's as simply because

play00:46

of pure mathematics thec dropped by

play00:50

almost 10% to 52% in the Free State we

play00:54

have a very small legislature of 30

play00:57

members so after the executive

play01:00

was constituted and put together thec

play01:03

were left with six seats in the

play01:06

legislature as opposed to the total

play01:08

oppositions 40 and we were very happy

play01:12

because we grew with an additional seat

play01:14

to seven so we comprise half of those 14

play01:18

seats so what it came down to is that

play01:20

thec were unable to fill all the

play01:23

positions because after they' filled the

play01:25

speaker Deputy speaker positions they

play01:28

still had chair of chairs Chief whip Etc

play01:31

and um there are eight committees that

play01:33

needed to be filled so after some time

play01:37

of negotiation since the election we

play01:40

managed to obtain um two chairperson

play01:44

positions the committee on petitions and

play01:47

the committee of infrastructure in the

play01:50

legislature and the eff and freedom

play01:52

front each got one committee

play01:55

chairpersonship as well and then thec

play01:58

were able to take up the committee chair

play02:01

positions this brings in a new type of

play02:04

dynamic within the legislature where we

play02:07

will be more consensus based we did

play02:10

indicate that we will continue to play

play02:13

an active opposition role in the

play02:15

legislature because the legislature's

play02:18

Constitutional mandate is to hold the

play02:21

executive accountable and that is what

play02:24

we'll do we'll just be able to do it

play02:26

from different positions within the

play02:28

legislature we also increased our

play02:30

numbers on committees from one person

play02:33

per committee to two people per

play02:36

committee which will also strengthen our

play02:38

position within committees So within the

play02:41

legislature I think we'll be working

play02:43

closer together as political parties to

play02:46

implement the legislature's

play02:48

Constitutional mandate it's also

play02:51

interesting because thec even had to cut

play02:53

one of their C their cabinet positions

play02:56

one of the

play02:57

mec's um to give them an additional seat

play03:00

in the legislature but in spite of that

play03:03

they they couldn't get the necessary

play03:05

majority they needed to fill all those

play03:07

seats and this is something that we

play03:09

predicted during the election

play03:12

campaign Ro does that make you more

play03:14

optimistic for the future of the

play03:16

province I remember the last time we

play03:17

spoke you were quite

play03:20

respondent yes I think um it it makes me

play03:24

optimistic for two reasons I think the

play03:26

legislature is stronger and one of the

play03:29

reasons why we've seen the decay in the

play03:32

free state of Service delivery and large

play03:35

scale corruption is because the

play03:37

legislature wasn't able to carry out its

play03:40

mandate to hold the

play03:42

executive um accountable because all the

play03:45

SE all the senior positions in the

play03:48

legislature all the committee chair

play03:50

positions were also held by thec who

play03:54

were also in the executive which is not

play03:56

an ideal situation that the P that the

play03:58

people who cheering the oversight

play04:00

committees um report to the same people

play04:04

um within the party over whom they are

play04:08

supposed to do oversight and who they

play04:10

supposed to hold accountable so I think

play04:13

things will look better from the

play04:14

legislature side and um we obviously

play04:18

will do everything we can to put

play04:21

alternatives on the table and ensure

play04:24

that these benefit the people of the

play04:26

Free

play04:27

State Roy now you recent recently

play04:30

received a public protectors report on

play04:32

the funeral costs of an MEC can you tell

play04:36

us what that report contain please yes

play04:40

um several months ago before the

play04:43

election one of our mec's passed away

play04:46

tragically in a motor vehicle accident

play04:50

near

play04:51

Windber and unfortunately the provincial

play04:55

government decided to use this to spend

play04:58

large amounts of money and close to 6

play05:02

million Rand was spent on the funeral

play05:04

costs of the Mec Andy protector and we

play05:08

regarded this these amounts as excessive

play05:11

and we reported it to the public

play05:14

protector and um last or two weeks ago

play05:18

the public protector brought out a

play05:20

report and agreed with a DA that the

play05:23

funeral costs were excessive but went a

play05:27

little bit further um in the investig

play05:29

ations and also found that there was a

play05:31

conflict of interest within the office

play05:35

of the Premier where officials were

play05:38

sitting um on the B adjudication

play05:41

committee but these same officials were

play05:43

also the people who drafted the

play05:45

specifications which is a clear conflict

play05:47

of interest and then there were also

play05:50

interestingly um increased amounts on on

play05:54

the tender that weren't in the

play05:56

specifications that were also approved

play05:59

subst stantial amounts and the

play06:01

recommendations of the public protector

play06:03

are firstly that the president and the

play06:07

national head of Treasury have to set

play06:11

the costs for um for State funeral so

play06:15

they must cap those costs which I think

play06:17

is a good outcome for the country at

play06:20

National and provincial levels where

play06:23

these costs weren't capped previously

play06:25

and became um excessive and then

play06:28

secondly the public protector also said

play06:31

that certain individuals from the

play06:33

director General in the Free State and

play06:36

the officials who were involved um must

play06:39

be subject to dis to disciplinary action

play06:43

and this within specific time frames and

play06:46

then also that the walks have to

play06:48

investigate this and I have confirmed

play06:50

that the walks are looking into these

play06:53

costs as well it is tragic that um a

play06:56

funeral of someone has to be turned into

play07:00

a public protector report and um we did

play07:03

our duty as the official opposition but

play07:07

I think that the executive must take

play07:09

into account that they're not doing

play07:11

anyone any favors when they do this and

play07:14

it it's not it's not good for for them

play07:18

or for the families involved when this

play07:20

type of thing happens R the last time we

play07:24

spoke uh you told me that state capture

play07:27

was perfected in the free state that the

play07:29

rule book was written there and was

play07:32

already applied somewhere else and

play07:34

that's much of that happened under the

play07:36

premier ship of a

play07:39

mar how is the fight to hold him

play07:44

accountable going Chris that's a that's

play07:47

a loaded question because in some

play07:50

respects there have been some

play07:52

improvements but in other respects it's

play07:54

more of the same um at provincial level

play07:57

we've heard rhetoric from our previous

play08:00

Premier and our current Premier

play08:03

regarding corruption and how they're

play08:05

going to fight corruption but the big

play08:07

fight against corruption is not going to

play08:10

be from political platforms and in

play08:13

rhetoric it's going to be actually doing

play08:16

away with the cader deployment policy

play08:19

which caused this and and ASM took that

play08:22

CER deployment policy and turned it into

play08:26

State capture in the Free State and in

play08:28

fact fact our always said perfected it

play08:30

there um as a perfect instrument to

play08:34

implement um these deals with with with

play08:38

tenderers in the province and that is

play08:42

the ma was the major CA of state state

play08:44

capture in the province and then this

play08:46

was also exported to the rest of the

play08:48

country not that it wasn't taking place

play08:50

in other parts of the country previously

play08:53

but I think in the pre free state we saw

play08:55

our um political power merged with

play09:00

executive authority to implement this

play09:02

and and perfect it um so there there has

play09:06

been the retoric from

play09:08

ourc leaders the newc factions in the

play09:12

free state but those caders who

play09:15

implemented these policies are still in

play09:17

place so the ANC still has to take this

play09:20

major decision and that is to do away

play09:24

with kada deployment and bring in

play09:27

expertise as the main

play09:29

um instrument for implementing or for

play09:32

for appointing officials within the

play09:35

administration and that has yet to be

play09:38

done and of course at Municipal level

play09:40

State capture is continuing unabated

play09:44

because um we see the the impact of this

play09:48

on Service delivery in our

play09:50

municipalities as we speak many

play09:53

municipalities and individuals on the

play09:55

ground of struggling still struggling

play09:58

with water they were struggling before

play10:00

the election and this hasn't changed for

play10:02

those people's people and this is a

play10:04

human rights issue we drafted a

play10:07

substantial report for the Human Rights

play10:10

Commission before the election which we

play10:13

submitted to them during their public

play10:15

hearings in the province we also

play10:17

published this internationally and we

play10:20

hope that this will have an impact um on

play10:23

Service delivery on the ground so we're

play10:25

waiting for the Human Rights Commission

play10:27

to bring their report and their

play10:29

recommendations as well but you know it

play10:32

impacts on the right to water it impacts

play10:35

on people's educational rights it has an

play10:38

economic impact which impacts on

play10:40

people's right to find employment and um

play10:45

to look after themselves to to supply

play10:48

livelihoods for themselves and their

play10:50

families so it is very Broad in the Free

play10:52

State because you can't have any

play10:54

development without water people can

play10:56

still live without electricity in roads

play11:00

but what is a basic human right now

play11:06

Roy former PA has been arrested in the

play11:09

United States and is going to be

play11:12

extradited what will that mean for his

play11:15

upcoming trial well we hope that we will

play11:18

have convictions because we've seen in

play11:21

the past that many officials have been

play11:23

arrested and officials are thrown under

play11:26

the bus during these investigations

play11:29

and if we could get a conviction of

play11:32

someone like a mul's trial starts in

play11:35

August in Earnest hopefully this time um

play11:39

it will send a clear message to the

play11:41

people of the Free State and the country

play11:44

that the state is serious about dealing

play11:47

with corruption and we hope that the

play11:50

state do have a watertight case in this

play11:54

regard and that we're not going to seen

play11:56

it like with other previous politicians

play11:58

in the in the Free State um thrown out

play12:02

of court um or having the case withdrawn

play12:05

we hope that we will see convictions but

play12:08

um obviously it's going to depend on how

play12:13

well our state prosecution um State

play12:16

Prosecuting Authority performs and the

play12:18

state prosecutors and of course on the

play12:21

political will to actually drive this

play12:24

through and make sure that that we have

play12:26

a good outcome and a good outcome is

play12:30

convictions we want to see people in

play12:33

Orange overalls in jail not just in the

play12:36

courts um endlessly turning to other

play12:40

crime in your region Roy uh some of

play12:43

bus's viewers have been touched to

play12:45

complain and share their FR frustrations

play12:49

with crossborder smuggling of vehicles

play12:53

with the cattle rustling that's also

play12:55

continuing unabated what can you tell us

play12:58

Chris this is one of of the most serious

play13:00

crimes in the fre that is the

play13:02

crossborder crime that is taking place

play13:05

and it has a huge economic impact not

play13:07

just for our border communities but e

play13:10

also the larger communities because it's

play13:13

not just the crime that's taking place

play13:16

um it's also the the crossborder influx

play13:20

of illegal immigrants who also involved

play13:22

in for example the Zama Zas in vom and

play13:26

the the human trafficking that's also

play13:28

take taking place there within those

play13:30

mines the abuse of people in those mins

play13:34

and um there doesn't seem to be a

play13:37

solution from law enforcement agencies

play13:40

for this problem I'm just setting up

play13:43

special task teams is not enough we need

play13:46

to see um a reduction in this on the

play13:49

ground but the crossborder crime is

play13:52

continuing unabated I visited the Border

play13:56

um a month or two ago and um actually

play14:00

witnessed firsthand the lack of law

play14:05

enforcement On the Border firstly the

play14:08

infrastructure there is no fence on the

play14:10

border I I just you know you just walk

play14:13

across you can see the poles where the

play14:16

fences were and you just step across

play14:18

from one side of the border to the other

play14:21

and as you look across the the hills and

play14:24

mountains there there's no visible

play14:26

policing there's no South African

play14:28

National Defense Force in sight there's

play14:31

no um police presence there in sight all

play14:35

what you see are the lutu um citizens

play14:39

cattle grazing on the South African side

play14:42

which happens um on a daily basis they

play14:45

chase their cattle across the border

play14:47

they graze there when the local farmers

play14:50

or communities um threaten to impound

play14:53

the cattle they set the grass and light

play14:55

during the Fire season and cause fires

play14:58

out of re venge attacks um and of course

play15:01

they the physical attacks as well by

play15:03

these cattle

play15:04

rustlers but while we were there we were

play15:07

also informed by the community of human

play15:10

trafficking that takes place across the

play15:12

border of the very serious drug

play15:16

trafficking that's taking place and then

play15:18

as you mentioned also the vehicle theft

play15:22

syndicates who crossing the border into

play15:25

lutu and um this doesn't only affect the

play15:29

Free State obviously these vehicles are

play15:31

coming from all over the country and the

play15:33

drugs don't only flow into the free

play15:37

state but also into other parts of the

play15:39

country as well and it's it's some of

play15:41

the stories we heard they are actually

play15:44

tragic of um you know local schools on

play15:47

the border on the South African side

play15:49

where children are addicted to these

play15:51

drugs and these drug traffickers come

play15:54

across the border and during breaks

play15:57

these kids um have to go and trade

play16:00

themselves for the drugs we've also you

play16:03

know heard stories of complicity with

play16:07

our law enforcement agencies where um

play16:10

they are in fact um assisting some of

play16:13

these criminals who are perpetrating

play16:16

these crimes and um it doesn't seem that

play16:19

there's the political will at this stage

play16:21

to deal with these issues at a national

play16:24

or provincial level and what's also

play16:28

taking plac is not just those types of

play16:30

crime but we also see the trafficking on

play16:34

in um illegal Goods such as um lion

play16:37

bones for example from from farms in the

play16:41

Free State because we have um sodic

play16:45

protocols within the southern African

play16:47

development community and anything

play16:49

that's packaged within one of those

play16:51

sadic countries is not subjected to

play16:56

searches at our ports of exit so if you

play17:01

package something in lutu in terms of

play17:03

those protocols it goes through the

play17:05

country and it is exported through our

play17:08

ports of exit without being searched

play17:10

because the sadic um

play17:15

agreements um are written in such a way

play17:18

that the countries are supposed to have

play17:20

mutual trust so we find that things are

play17:23

packaged there into containers um

play17:26

hopefully not humans as well but it's

play17:29

not impossible and then are exited um

play17:32

and they not are taken through our

play17:34

country and to our ports of exit and and

play17:37

then find their way to places abroad

play17:41

well with the appointment of a new

play17:42

minister of police there are people who

play17:44

are

play17:45

hopeful uh that there could be action

play17:48

certainly at National level and

play17:50

hopefully also at provincial level what

play17:52

do you think Roy well we are hopeful

play17:55

that the new government of national

play17:57

Unity will um follow a new approach when

play18:00

it comes to dealing with crossborder

play18:02

crime and we hope that Ian Cameron will

play18:05

be very successful on the portfolio

play18:08

Committee of police in Parliament and I

play18:10

think you did interview him recently as

play18:13

well so we are hopefully that hopeful

play18:15

that things will in will improve but

play18:18

what we'll need to do is improve the

play18:20

whole culture of law enforcement in the

play18:24

country um because I always say that the

play18:27

best deterrent who would be criminals is

play18:30

the knowledge that if you do commit a

play18:32

crime you will be detected you will be

play18:36

convicted and you will be punished the

play18:38

type of punishment death penalty Etc I

play18:41

think is less of a deterrent than the

play18:44

knowledge that you will in fact be um

play18:47

caught and you will be nailed and jailed

play18:50

if you commit a crime and we need to to

play18:54

to bring that about through perhaps

play18:56

changes in policies and the most

play18:59

important thing I think is the change in

play19:01

culture and in the political world to

play19:03

actually Implement our laws because it's

play19:06

not the lack of legislation that is

play19:08

causing the crimes but it's the lack of

play19:11

implementation of this legislation and

play19:14

we are very good policies as the da that

play19:17

we think can assist in the fight against

play19:20

Crime um the

play19:22

decentralization of law enforcement to

play19:25

provincial and local level and then also

play19:28

the implement ation of special rural

play19:30

units that can deal with crossborder

play19:32

crime and Rural crimes using technology

play19:36

drone technology cameras and various

play19:38

other means to fight against Crime thank

play19:42

you that was Democratic Alliance free

play19:45

state leader Roy yilson speaking to

play19:48

businesss viewers about crime and

play19:51

politics in his Province thank you Roy

play19:53
