Transcripts

play00:00

there are two things I really hate about

play00:02

politics the first is the bending and

play00:05

the twisting of the truth evading the

play00:07

question which as a barrister is really

play00:09

frustrating because I like a straight

play00:11

answer to a very straightforward

play00:12

question and the inconsistencies between

play00:15

answers or giving an answer to a

play00:18

different question that wasn't asked

play00:20

added to the fact that you cannot

play00:22

legally hold MPS accountable for what

play00:25

they said when they were campaigning to

play00:27

get into government and there's a great

play00:29

video on that by my learned friend Alan

play00:30

Robert shw I'll find it and I'll link it

play00:32

in the description below but it's this

play00:34

General bending and twisting of the

play00:35

truth is the first thing that really

play00:37

frustrates me and it's that element of

play00:39

trust trusting what somebody says and

play00:42

trusting them to answer the question the

play00:44

second is that we are all accountable to

play00:47

government and the rules that they make

play00:49

regardless whether we agree with them or

play00:51

not regardless of whether you think that

play00:54

you voted for what they are doing

play00:56

because you may have thought one thing

play00:58

when they are campaigning and they do

play00:59

something else else and again they're

play01:00

not held accountable to it and those are

play01:02

the two things that have kept me out of

play01:04

politics but lots of you have asked me

play01:06

to talk about this so if you want a

play01:07

brutally honest Frank appraisal of what

play01:10

I see going on in the news please do

play01:12

consider subscribing to my Channel about

play01:14

60% of the millions of you that watch

play01:15

every month don't do so I'd like to

play01:17

think that I offer some insight as a

play01:20

barister and as a citizen myself living

play01:22

under the same rules and how I work

play01:24

within those rules uh so please do

play01:26

subscribe and I'll offer you my insight

play01:28

for those that just want my legal videos

play01:29

I will still do those and they are

play01:31

obviously in the library there's a

play01:32

couple of thousand videos in there so

play01:34

there's something for everybody so thank

play01:36

you for doing that so what sparked this

play01:37

video today and why am I talking

play01:40

specifically about the honesty and the

play01:42

consistency of all of this let's take a

play01:45

first look at this bit here which is

play01:47

this is to do with the winter fuel

play01:48

allowance there's two or three bits in

play01:50

this video which and at the end of the

play01:51

video there's going to be a collection

play01:53

of different things which all seem

play01:55

contradictory and I'll leave you to make

play01:56

your own mind up about that and for the

play01:58

avoidance of doubt I am not in any

play02:00

saying that anyone is being fraudulent

play02:01

in this video these are just

play02:02

observations for legal reasons you

play02:04

understand take a listen to this bit

play02:06

first this is about the winter fuel

play02:07

allowance of what saki starma said in

play02:09

May

play02:10

2024 about um what was said last year

play02:13

listen to this last year the Prime

play02:16

Minister was apparently drawing up plans

play02:18

to remove the winter fuel allowance from

play02:21

pensioners his pay Master General went a

play02:23

step further he said these are the sorts

play02:25

of things that we need to look at so

play02:28

will he now rule out taking pensioners

play02:31

winter fuel payments off them and I

play02:34

don't think I need to play anymore

play02:36

because that's obviously crystal clear

play02:38

because that's precisely what they're

play02:39

doing now so I don't want to come across

play02:42

and I don't want anyone to judge me as

play02:44

being against one government and for

play02:46

another I'm just calling out what I see

play02:49

this is a fundamentally different

play02:52

position to what's happening now and I'm

play02:54

sure if I ask the question because he's

play02:57

answered the question this way he will

play02:59

blame previous government and some black

play03:01

hole that they claimed to have found

play03:03

which I come back to in a moment but

play03:04

it's this inconsistency is the first

play03:06

thing that I don't like and the second

play03:08

thing that follows is if they decide to

play03:10

take it away it's gone and so the

play03:13

pensioners that did depend on that or

play03:15

would have depended on that obviously

play03:17

cannot now do so but then again with my

play03:20

first reason is this sort of bending and

play03:23

twisting of the truth and dodging and

play03:24

evading the question whilst he does

play03:26

answer the question but not so directly

play03:29

when asked about the winter fuel

play03:30

allowance and what would he say to

play03:33

people that are having this removed this

play03:36

is what he said what about the people

play03:38

who have worked all of their lives paid

play03:41

into the state pensioners how can you

play03:46

justify taking away up to

play03:50

£300 from those formerly working

play03:54

people so just to clarify the question I

play03:56

know she said it very clearly but I want

play03:58

to emphasize the perfect clarity of that

play04:01

question how can you justify taking that

play04:04

away bearing in mind everything else

play04:06

that's going on how can you justify

play04:08

taking that away and this is the answer

play04:11

well it's tough and I think the first

play04:14

thing to say is and to explain is why we

play04:18

had to do it we inherited a really

play04:21

damaged economy we did an audit and we

play04:25

discovered an undisclosed 22 billion

play04:27

pound black hole this year

play04:30

which we have to fix we have to fix that

play04:32

black hole includes public sector pay

play04:33

Rises well the last government set up

play04:36

the pay review bodies for and so this

play04:39

goes on to essentially for one blame the

play04:41

previous government which I'm not saying

play04:43

is wrong necessarily um and also the 22

play04:46

billion pound black hole that they found

play04:49

which again is not entirely uh

play04:52

straightforward but I'll come back to

play04:53

that in a second but it doesn't directly

play04:56

answer the question is what would you

play04:57

say to those people now the answer to

play04:59

that according to K here is to explain

play05:03

that it's the previous government's

play05:04

fault they had a bad economy Etc but

play05:08

that then begs the question if this

play05:09

economy is so bad then surely there's

play05:13

lots of other areas to cut back on

play05:15

spending and those that are most

play05:17

vulnerable according to Kama himself and

play05:20

previous reports that have said lots of

play05:22

people are at risk of dying of of cold

play05:26

if they don't get this fuel allowance

play05:28

and they can't Heat their houses

play05:29

properly

play05:30

then lots of those are at risk and yet

play05:33

it's being taken away anyway and even

play05:36

when we look at the claim about this 22

play05:39

billion pound black hole um fact check

play05:42

and the BBC and other sources have all

play05:44

said well it's not entirely true it says

play05:49

that some bits of it such as the BBC

play05:52

reported that there was an unfunded uh

play05:55

six something billion p6.4 billion pound

play05:58

cost of support the Asylum system was

play06:01

unfunded for example uh much of the

play06:04

other stuff they would have already been

play06:05

aware of so both fact check the BBC and

play06:08

other sources all say that not all of

play06:11

this was entirely unexpected so that's

play06:13

not entirely clear either so blame the

play06:16

previous government blame the black hole

play06:18

I'm not saying the previous government

play06:19

was perfect and I'm not saying the

play06:21

economy isn't in a terrible state I'm

play06:23

not an economist but I don't need to be

play06:24

an economist to know that the economy is

play06:26

in a bit of a state But to answer it

play06:29

that way not directly answer the

play06:31

question by giving this roundabout

play06:33

explanation is a little bit

play06:36

frustrating um secondly the second thing

play06:39

to uh bring up for this video uh that

play06:41

spark this video today is this bit here

play06:44

which again is bending and twisting of

play06:46

the truth this is K st's own X account

play06:49

Twitter if you absolutely insist um he

play06:52

says here in two tweets uh in reverse

play06:54

order we can build a future where AI dri

play06:56

drives growth creates wealth Etc um

play06:59

speaking of create wealth if you want to

play07:00

create wealth with me join my Daniel

play07:02

shens Smith Channel Linked In the

play07:04

description below it's growing nicely

play07:05

and I'll help you to make money on that

play07:07

channel head over there and I'll see you

play07:08

there as well but he says here uh new

play07:13

now emphasis I'm being being the lawyer

play07:15

about this I do pick up on every word he

play07:18

says new so this is apparently new

play07:23

information emphasis on the new there

play07:25

you see I'm being sarcastic here to be

play07:27

funny because um he being sarcastic in

play07:29

government I don't really like that

play07:30

across the bench but that's by The Bu he

play07:32

says here new we've secured investment

play07:36

to create one of the largest AI data

play07:37

centers in Europe based on the northeast

play07:40

of England delivering jobs and wealth

play07:41

creation my number one mission is to

play07:43

grow the economy with my government

play07:44

Britain is back as great you grow the

play07:47

economy great secure these deals great

play07:49

secure Investments great but it it comes

play07:52

to something when you can see this here

play07:54

is because I'm a community notes author

play07:56

for X um which are all anonymized by the

play07:59

way no one knows who anybody is but um

play08:01

it does give you access to the to write

play08:03

proposed Community notes and one of

play08:06

those takes you to this article here

play08:09

that says actually no this isn't new

play08:13

this was announced a while ago um and

play08:17

this says quite tongue-in-cheek stama

play08:20

announces deal signed under rishy sunak

play08:24

and it says here st's meeting with

play08:25

businesses this morning in New York to

play08:27

uh convince them to invest in the UK to

play08:29

prove he's already making successful

play08:30

investment in the government has

play08:32

announced um that he secured a 10

play08:35

billion uh pound deal for the US

play08:37

Investment Company Blackstone to build

play08:38

the biggest AI data center but this deal

play08:41

was signed off and publicized months

play08:43

before the election on the 15th of April

play08:45

and was fully confirmed a few weeks

play08:47

later and that's these two articles here

play08:49

this one's dated the 15th of April this

play08:52

is when it was all sort of signed off

play08:54

and it's the same deal as I understand

play08:56

it and it was finalized

play08:59

a few weeks later in May and so this

play09:03

isn't new at all now to say new we have

play09:08

secured this

play09:09

investment from what I've read for legal

play09:12

reasons from what I've read That's not

play09:14

entirely true so it's this sort of

play09:16

bending and the twisting of the truth

play09:18

and it it does throw into question your

play09:20

trust in the people that are making the

play09:22

decisions that are making these

play09:24

statements running the government and

play09:26

not not least of which the

play09:27

contradictions previously many of which

play09:30

I'll come back to at the end of the

play09:31

video um but it does throw into play

play09:33

this whole trust thing now bring you a

play09:36

little closer for a minute because I've

play09:37

got a story of trust myself here so I

play09:40

received a phone call yesterday and this

play09:42

is an entirely separate matter but I

play09:44

received a phone call yesterday and to

play09:46

my personal phone number very few people

play09:49

have my personal phone number even when

play09:50

I ring clients with all respect to

play09:52

clients that I've spoken to I withhold

play09:53

my number so they don't get my personal

play09:55

phone number I use my personal phone

play09:57

number for personal things but if I ring

play09:59

people with my personal number they

play10:01

don't have my number except very very

play10:03

very few and likewise companies most

play10:06

companies don't have my phone number so

play10:07

most people don't have my phone number I

play10:09

think that's clear by now but I received

play10:11

a phone call from a company I had no

play10:13

idea who they were I had no idea nor

play10:16

interest in what they were trying to

play10:17

sell me and I straight away very

play10:19

politely said where did you get my phone

play10:22

number and they said we subscribe to a

play10:24

service which gives us access to

play10:27

decision makers names and numbers and

play10:29

all personal details to get a hold of

play10:32

you he was quite Frank and open about

play10:33

that of course the way I asked him the

play10:35

question very

play10:36

directly inspired a direct answer from

play10:39

him which I'm grateful for he gave me a

play10:41

direct answer but that then tells me

play10:44

that there's a company selling my data

play10:47

now this really irritates me because

play10:49

this is an ongoing thing with me there

play10:51

are new companies popping up all the

play10:53

time marketing and quite literally

play10:56

selling access to my data

play10:59

so I've since written to that company

play11:01

and I've threatened to sue them I've

play11:02

said first of all where did you get it

play11:05

how did you get it how long have you got

play11:06

it what did you plan to do with it why

play11:08

have you collected it and essentially

play11:10

they're in breach of gdpr because this

play11:12

is a personal phone number there's no

play11:13

legitimate interest there's no contract

play11:15

interest there's no other reason they

play11:16

should have it so they should remove it

play11:18

they replied very quickly to say they've

play11:20

removed it or going to remove it but

play11:22

nothing else but they are in breach and

play11:24

so whilst it I could just drop it they

play11:27

are in breach and it does give rise to

play11:29

damages but the point here is all of

play11:32

your data is being sold on quite

play11:34

literally sold on and that really

play11:36

infuriates me which is why I work with a

play11:38

company called incog which goes to these

play11:41

data Brokers and marketers who collect

play11:44

all this information about you they

play11:45

collect your name your date of birth

play11:47

your address your phone number your

play11:48

emails your interests what you serve for

play11:51

online all of this sort of stuff they

play11:53

put you together like a jigsaw puzzle

play11:55

and they sell you as they sold me the

play11:57

day before yesterday and incognit will

play11:59

demand on your behalf that your data is

play12:01

removed from their servers there are

play12:03

hundreds of these Brokers and they will

play12:04

do all of that for you now I've got a

play12:06

long list on the dashboard that I get

play12:08

with incognet that tells me the

play12:09

companies they've approached that have

play12:11

confirmed that they've removed my data

play12:13

new ones as they pop up because this is

play12:14

an ongoing thing there are always more

play12:16

going on you'll get a huge 60% discount

play12:19

if you use my code in the description

play12:21

below and the links there as well and

play12:24

they will go to these data Brokers and

play12:26

they will tell them under both the UK

play12:28

and US la to remove your data from their

play12:31

servers that prevents it from being sold

play12:33

on any further and it stops this kind of

play12:35

spam and more importantly it will stop

play12:39

it ending up or hopefully stop it ending

play12:41

up on the dark web where more nefarious

play12:44

actors take your data as we've had

play12:46

clients come to the firm and had loans

play12:48

and other things taken out in their name

play12:50

and it will hopefully prevent that from

play12:52

happening because that is a far worse

play12:53

situation than an annoying phone call so

play12:56

check out incog in the description below

play12:58

with my link and code and now let's take

play13:00

a look at this hugely contradictory and

play13:03

somewhat entertaining or it would be

play13:05

entertaining if it wasn't so infuriating

play13:07

video of of different contradictions

play13:09

that K stama has made take a listen to

play13:12

this really it was so important to her

play13:15

however ill she was as a matter of

play13:17

absolute principle she felt that you

play13:19

shouldn't make money for mental health

play13:22

and that's it is a matter of principle

play13:24

it's an absolute matter of

play13:26

principle So that obviously talking

play13:28

about Healthcare and private healthcare

play13:30

and things like that and that original

play13:31

video was in 2020 so that was about

play13:33

paying privately for healthcare and

play13:35

things like that now listen listen to um

play13:38

the next bit which is obviously later um

play13:40

our research shows that that's been

play13:42

underused and we could do more of it

play13:44

that would clear you know 230,000 people

play13:47

off the waiting more use private sector

play13:49

in the NHS under labor

play13:51

yes a direct a contradiction uh so you

play13:54

can see the contradictions here let's

play13:56

play another one sector in the NHS under

play13:58

labor yeah

play13:59

Manifesto what about univers tuation

play14:01

fees then will you remain committed to

play14:03

scrapping them first term all pledges

play14:06

Andrew so the answer to these questions

play14:07

is yes but but it won't be the it won't

play14:10

be the abandoning of tuition fees will

play14:11

it well we are likely to move on from

play14:13

that um

play14:15

commitment so again whilst he says it's

play14:18

a pledge we're going to do this promise

play14:20

to do a certain thing to hopefully Ghana

play14:23

votes to get into government and then

play14:25

later on just Backtrack on it just

play14:28

actually we're going to move on from

play14:29

that not doing that anymore and for

play14:31

reasons um I'll leave to the video for

play14:35

uh from Alan Robert show I'll link in

play14:36

the description below they can't be held

play14:39

accountable to these things only at the

play14:42

next vote but again let's listen on

play14:45

we're campaigning to ensure conversion

play14:48

therapy is banned once and for all and

play14:52

we're committed to updating the gr to

play14:55

introduce self- declaration for Trans

play14:57

people

play14:59

the so updating the gender recognition

play15:02

act for self-identification for Trans

play15:05

people and then this one uh second part

play15:10

of your question was I'm sorry I've

play15:12

just oh uh yeah look I mean I think that

play15:16

um if we reflect on what's happened in

play15:19

Scotland um the lesson I take from that

play15:22

is that um if you're going to make

play15:25

reforms you have to carry the public

play15:27

with you and I think that's a very

play15:29

important U message and I think that's

play15:31

why it's clear that in Scotland there

play15:33

should be a reset of the

play15:35

situation so they're saying look at

play15:38

what's happened in Scotland actually we

play15:40

need to rethink that which is not

play15:42

necessarily a bad thing because if you

play15:45

see what's happening and you react to

play15:46

that that's fine but then the statement

play15:48

of using that statement to say we have

play15:49

to be in line with the public if you

play15:52

take that and apply it to the current

play15:53

situation I think the vast my my

play15:56

certainly my impression correct me if

play15:57

I'm wrong in the comments but My overall

play15:59

impression is that the general public

play16:02

are against lots of these things that

play16:04

are going on at the moment my general

play16:06

impression is that lots of the public

play16:08

are against the removal of the winter

play16:09

fuel allowance which is um somewhat

play16:12

illustrated by the labor conference

play16:15

voting um to backtrack on that removal

play16:18

um my general impression again is that

play16:20

the general public are against everyone

play16:23

that was campaigning receiving gifts and

play16:25

donations which albe it declared look

play16:28

look like they are a wrong influence I'm

play16:31

not saying they are for legal reasons

play16:33

but it looks bad I think a lot of people

play16:36

think it looks bad um that's the reason

play16:38

they have to be declared in the first

play16:39

place now regardless I mean barrs don't

play16:42

have a register of Declarations of

play16:45

Interest with our representative body of

play16:47

the Bar Council we don't say I have

play16:49

someone that's you know donating this

play16:51

much to me therefore I'm not compromised

play16:53

on this case doesn't work like that what

play16:55

we do do is if we work with a company or

play16:58

you know in-house coun with the company

play16:59

we we inform the records department and

play17:01

we tell them that we work in that

play17:03

company but if we receive a gift or a

play17:06

donation or whatever uh we have to

play17:09

absolutely be sure that it's not it is

play17:12

not or is not seen to be affecting our

play17:14

independence which I've mentioned in

play17:16

previous videos now there is one case

play17:18

I'm not going to name any names uh for

play17:20

to avoid embarrassment but there is one

play17:22

case where a barrister was found to have

play17:26

been um giving cash to a former client

play17:30

uh who he felt sorry for because she was

play17:33

going to be in a very difficult

play17:35

situation and so after the case had

play17:38

finished gave her some money because he

play17:40

felt like he wanted to help her out and

play17:42

as I recall he was suspended from

play17:44

practice for six months for doing that

play17:46

because it would it looks like it would

play17:48

um both bring the profession into

play17:49

disrepute and it would compromise his

play17:53

Integrity uh and Independence so that is

play17:55

the level of Independence that we need

play17:57

to maintain which is why any of us

play17:59

barters would be extremely careful to

play18:02

accept any gift or donation most of us

play18:04

would just outright refuse it now many

play18:05

barters might receive the odd gift here

play18:07

or there bottle of wine or bottle of

play18:10

something um and that's not really here

play18:12

or there but if it was a large gift or

play18:15

certainly a monetary gift over and above

play18:17

the fees um that might look questionable

play18:20

and so barers wouldn't do it and so

play18:21

therefore I I think it looks bad uh for

play18:24

politicians to do it when they're

play18:25

campaigning to get into government

play18:27

especially when it's uh written up in

play18:30

sort of a vague or broad way that could

play18:33

be interpreted another way so office

play18:35

support which is really clothing now had

play18:38

they just said it was clothing that

play18:40

might be a different matter and so these

play18:41

really are the things that I take issue

play18:43

with either not answering the question

play18:45

directly answering the question with

play18:47

something that was completely different

play18:49

or going back on promises or just

play18:52

pretending that that wasn't important or

play18:54

exaggerating things all of these kind of

play18:56

things I know that it's an art of

play18:59

persuasion and all of this sort of stuff

play19:02

but it's just something I don't like I

play19:04

like direct straight answers to

play19:06

questions and if there is a reason um so

play19:09

for example the gender recognition act

play19:12

um there was a good reason to say well

play19:14

we've seen what happened in Scotland we

play19:16

need to backtrack on that that's fine I

play19:19

mean that was a direct answer so that at

play19:21

least was clear uh so I don't want

play19:24

anyone to think that I'm bashing any one

play19:26

government or another but I am going to

play19:27

call out precis ly what I see and what I

play19:30

think of it and humbly lots of you have

play19:33

said that you like to hear my views on

play19:34

that so for that I would ask you please

play19:36

do subscribe to come back for more and

play19:38

I'll will see you all next time
